dc.description.abstract | Maģistra darba tēma ir Negatīvā atzīšanas prasība civilprocesā. Darbā pētīts negatīvās atzīšanas prasības institūts sākot ar tā vēsturisko izcelsmi, tā saistību ar tiesībām uz tiesu, iespējamām problēmām civilprocesā, tā īpatnībām, visbeidzot apskatot arī ārvalstu un Eiropas Savienības Tiesas interpretāciju. Darba ietvaros autore atspēko Latvijas Republikas Augstākās tiesas Senāta judikatūrā paustos argumentus, ka personām nav prasījuma tiesību celt negatīvu atzīšanas prasību. Darba rezultātā tiek izvirzīts secinājums, ka Latvijas civilprocesuālais regulējums ļauj celt tiesā negatīvu atzīšanas prasību. Darbs sastāv no četrām nodaļām, kopējais lappušu skaits 84. | lv-LV |
dc.description.abstract | The subject of the master’s thesis is an action for negative declaratory judgement in civil procedures. The thesis researches the institute of negative declaratory claim, starting with its historical origin, its connection with the right to fair trial, possible problems in civil procedure, its peculiarities, and finally with the interpretation of foreign states and European Court of Justice. Within the framework of the thesis, the author disproves the arguments, expressed in the case law of the Senate of the Supreme Court of the Republic of Latvia, that persons have no right to bring a negative declaratory claim. As a result of the work, it is concluded that Latvian regulation on civil procedure allows to bring an action for negative declaratory judgment. The work consists of four chapters, altogether 84 pages. | en-UK |
