Kriminālatbildība par viltus ziņu izplatīšanu digitālajā vidē

Abstract

Maģistra darba tēma ir “Kriminālatbildība par viltus ziņu izplatīšanu digitālajā vidē”. “Latvijā ir strauji pieaugusi viltus ziņu un dezinformācijas izplatība aizvadīto divu gadu laikā, ko veicinājuši pandēmijas un ģeopolitiskās situācijas apstākļi. Kampaņā “ES pret dezinformāciju” 2021.gada pavasarī konstatēti vairāk nekā 11 000 prokremliskās dezinformācijas izplatīšanas gadījumu.” Maģistra darba mērķis ir analizēt normatīvo regulējumu, kas paredz kriminālatbildību par viltus ziņu izplatīšanu digitālajā vidē un tiesu praksi, konstatējot iespējamās problēmas un piedāvājot tām risinājumus. Maģistra darbs sastāv no trīs nodaļām. Pirmajā nodaļā “Viltus ziņu un citu saistīto jēdzienu saturs” darba autore apskata dažādus ar “viltus ziņu” saistītos jēdzienus, kā, piemēram, “nepatiesas ziņas”, “dezinformācija, “maldinoša informācija”, kā arī “viltus ziņu” vēsturisko attīstību. Otrajā nodaļā “Huligānisma sastāva juridiskā analīze un tiesu prakse” darba autore analizē noziedzīgā nodarījuma sastāvu un tiesu praksi. Trešajā nodaļā “Ārvalstu krimināllikuma regulējums un tiesu prakse” tiek analizēts Baltijas valstu krimināllikuma regulējums un tiesu prakse lietās par viltus ziņu izplatīšanu digitālajā vidē. Maģistra darba nobeigumā ir izdarīti secinājumi un priekšlikumi par Latvijas normatīvajā regulējumā nepieciešamo grozījumu veikšanu, lai preventīvi sabiedrībai būtu skaidrs par kādām darbībām var iestāties atbildība saistībā ar viltus ziņu izplatīšanu. Maģistra darba kopējais apjoms ir 92.lpp.

The topic of the master thesis is "Criminal liability for dissemination of fake news in the digital environment". "The spread of fake news and disinformation in Latvia has increased sharply over the past two years, fuelled by pandemics and the geopolitical situation. The EU Against Disinformation campaign detected more than 11 000 cases of pro-Kremlin disinformation in spring 2021." The aim of the Master's thesis is to analyze the legal framework criminalizing the dissemination of fake news in the digital environment and the case law, identifying potential problems and proposing solutions. The Master's thesis consists of three chapters. In the first chapter, "The content of fake news and other related concepts", the author discusses various concepts related to "fake news", such as "false news", "misinformation", "misleading information", as well as the historical development of "fake news". In the second chapter, "Legal analysis and case law on the offense of hooliganism", the author analyzes the offense and the case law. The third chapter, "Foreign Criminal Law and Case Law", analyzes the criminal law and case law of the Baltic States in cases of dissemination of fake news in the digital environment. The Master's thesis concludes with conclusions and proposals on the necessary amendments to be made to the Latvian legal framework in order to make it clear to the public, as a preventive measure, what actions may be punishable in connection with the dissemination of fake news. The total length of the master thesis is 92 pages.
