Komerciālās surogātmātes institūta legalizācijas perspektīva Eiropas Savienībā: cilvēktiesiskās un ētiskās problēmas

Abstract

Komerciālās surogātmātes perspektīvas tēma Eiropas Savienībā rada ētiskas un tiesiskas problēmas, kuras tika rūpīgi izpētītas. Šai tēmai ir zināma ietekme uz cilvēktiesībām un citām tiesību un sabiedriskās prakses jomām. Darbā tika veikta ētisko aspektu analīze, kas vistiešākajā veidā saistīta ar cieņas jautājumiem pret cilvēka cieņu, bērnu tiesībām un sieviešu tiesībām. Jāatzīmē, ka surogātmātes komercializācijas perspektīva rada bažas par sieviešu nelikumīgas ekspluatācijas riskiem, bērnu tirdzniecības iespējamību, kā arī tas var radīt problēmas pašu surogātmāšu veselībai. No tiesību viedokļa komerciālās surogātmātes perspektīva Eiropas Savienībā saskaras ar tiesību sistēmu dažādību dažādās dalībvalstīs, kas arī ir izskatītas šajā darbā. Sakarā ar to, ka ES nav vienotas tiesiskās pozīcijas un normatīvā regulējuma, ir pietiekami sarežģīti nodrošināt visu procesa dalībnieku tiesību aizsardzību: bioloģiskie vecāki, surogātmātes un bērni. Šī nostāja rada jautājumus par to bērnu dzimstības un pilsonības atzīšanu, kuri dzimuši surogātmātes rezultātā ārvalstīs. Kopumā, darba procesā tika veikts pētījums, kas izgaismoja komerciālās surogātmātes ētiskos un tiesiskos aspektus ES. Vēlāk tika piedāvāti mehānismi iespējamās komerciālās surogātmātes regulēšanai, kas nodrošinātu visu šī procesa dalībnieku tiesību un interešu aizsardzību. Regulēšanas mehānismi tika piedāvāti, balstoties uz starptautiskiem līgumiem, kas vērsti uz atsevišķām ievainojamām grupām - sievietēm, bērniem, invalīdiem un tā tālāk, piemēram, Konvencija par jebkuras sieviešu diskriminācijas izskaušanu, Konvencija par bērna tiesībām, Konvencija par personu ar invaliditāti tiesībām un citas.

The theme of the commercial surrogacy perspective in the European Union raises ethical and legal problems that were thoroughly explored. This topic has some impact on human rights and other areas of law and public practice. The work carried out an analysis of ethical aspects directly related to respect for human dignity, children's rights and women's rights. It should be noted that the prospect of the commercialisation of surrogate mothers raises concerns about the risks of illegal exploitation of women, the likelihood of child trafficking, as well as the health of surrogate mothers themselves. From a legal point of view, the perspective of commercial surrogacy in the European Union is faced with the diversity of legal systems in the various Member States, which have also been examined in this work. Due to the lack of a single legal position and regulatory framework in the EU, it is sufficiently difficult to ensure the protection of the rights of all actors in the process: biological parents, surrogates and children. This position raises questions about the recognition of births and citizenship of children born as a result of surrogacy abroad. Overall, a study was carried out during the work process which highlighted the ethical and legal aspects of commercial surrogacy in the EU. Mechanisms were subsequently proposed to regulate a potential commercial surrogate, which would ensure the protection of the rights and interests of all parties to the process. Regulatory mechanisms were proposed on the basis of international treaties targeting certain vulnerable groups - women, children, disabled people and so on, such as the Convention on the Elimination of all forms of discrimination against Women, the Convention on the Rights of the child, the Convention on the Rights of persons with Disabilities and others.
