Kriminālsoda noteikšanas tiesiskie un praktiskie aspekti

Abstract

Maģistra darbā temats ir "Kriminālsoda noteikšanas tiesiskie un praktiskie aspekti". Darba mērķis ir izpētīt tiesisko regulējumu un tiesu praksi attiecībā uz kriminālsoda noteikšanu, izvirzīt priekšlikumus konstatētajām nepilnībām. Darbā tiek analizēti soda noteikšanas vispārīgie principi, kas ietekmē soda veida un apmēra izvēli, kā arī tiks analizēti soda noteikšana par vairākiem noziedzīgiem nodarījumiem un pēc vairākiem spriedumiem. Ievadā tiek sniegts teorētisks pamatojums par kriminālsoda politiku, tās nozīmi noziedzības apkarošanā un tās saistību ar valsts pārvaldi un tiesību jaunradi. Turklāt tiek aplūkoti Krimināllikuma pantu nosacījumi, kas regulē kriminālsoda noteikšanu Latvijas Republikā. Pētījuma gaitā tiek analizēti 38 tiesas nolēmumi, lai identificētu interpretācijas nepilnības tiesu praksē saistībā ar soda noteikšanu. Šī analīze sniedz ieskatu esošajās problēmās un varētu piedāvāt ieteikumus, kā uzlabot šo procesu. Darba rezultāti atklāj, ka ir nepieciešama vienota un skaidra interpretācija, turklāt tiek izceltas konkrētas interpretācijas neprecizitātes, kas novērotas tiesu praksē. Šis maģistra darbs sniedz ieguldījumu tiesību zinātnes jomā, piedāvājot ieskatu kriminālsoda noteikšanas tiesiskajos un praktiskajos aspektos un sniedzot ieteikumus šī procesa pilnveidošanai.

The Master's thesis is entitled "Legal and Practical Aspects of Criminal Sentencing". The aim of the thesis is to study the legal framework and case law on the determination of criminal penalties, to put forward proposals for the identified shortcomings. The work analyses the general principles of sentencing, which influence the choice of the type and amount of sentence, and will also analyse sentencing for a number of offences and following a number of sentences. The introduction provides a theoretical background to criminal sentencing policy, its role in the fight against crime and its relationship to public administration and legal innovation. In addition, the provisions of the articles of the Criminal Law which regulate the imposition of criminal penalties in the Republic of Latvia are examined. In the course of the study, 38 court decisions are analysed in order to identify interpretive gaps in judicial practice in relation to sentencing. This analysis provides insight into the existing problems and could offer recommendations on how to improve the process. The results of the work reveal the need for a uniform and clear interpretation, and highlight certain interpretative inaccuracies observed in case law. This Master's thesis contributes to the field of law by offering insights into the legal and practical aspects of criminal sentencing and making recommendations for improving the process.
