Vardarbības pret sievieti novēršanas tiesiskie un praktiskie aspekti Latvijā

Abstract

Maģistra darba temats ir “Vardarbības pret sievieti novēršanas tiesiskie un praktiskie aspekti Latvijā” un mērķis – pētot un analizējot Latvijas un starptautiskos tiesību aktus un praktiskās problēmas, konstatēt nepilnības un izstrādāt ieteikumus nepilnību novēršanai Latvijas tiesiskajā regulējumā, tiesībaizsardzības sistēmā un rehabilitācijas pakalpojumu sniegšanas jomā. Ņemot vērā esošas nepilnības Latvijas Republikas tiesiskajā regulējumā, tiesībaizsardzības sistēmas darbībā un rehabilitācijas pakalpojumu sniegšanas jomā saistībā ar vardarbību pret sievieti un vardarbību ģimenē, un to, ka 2023.gadā 30.novembrī Latvija ratificēja Eiropas Padomes Konvenciju par vardarbības pret sievietēm un vardarbības ģimenē novēršanu un apkarošanu (Stambulas konvencija, 2011), kura stāsies spēkā 2024.gadā 1.maijā, ir nepieciešams aktualizēt Latvijas Republikas esošo tiesisko regulējumu saistībā ar vardarbību pret sievietēm un vardarbību ģimenē, uzlabot tiesībaizsardzības sistēmas darbību un novērst nepilnības rehabilitācijas pakalpojumu sniegšanas jomā. Darbs sastāv no četrām nodaļām un sešām apakšnodaļām, un tā kopējais apjoms ir 71 lappuse. Darba izstrādes laikā, darba autore ir noskaidrojusi, ka starp institūcijām nepastāv vienots sadarbības modelis. Vienots modelis nepastāv arī gadījumu reģistrēšanas jomā, sakarā ar ko nav iespējams izsekot gadījumu atkārtotību, jo lielākā daļa informācijas tiek ievadīta manuāli, kas patērē laiku. Tāpat darba autore ir noskaidrojusi, ka Latvijā izplatītākais vardarbības veids ir emocionālā vardarbība, kas nav kriminalizēta. Darba izstādes gaitā darba autore izvirzīja sešus priekšlikumus, kas sekmētu vardarbības apkarošanu.

The topic of the master's thesis is "Legal and practical aspects of preventing violence against women in Latvia" and the goal is to identify gaps and develop recommendations for the elimination of gaps in the Latvian legal framework, law enforcement system and the provision of rehabilitation services by studying and analyzing Latvian and international legislation and practical problems. Taking into account existing shortcomings in the legal framework of the Republic of Latvia, the operation of the law enforcement system and the provision of rehabilitation services in connection with violence against women and domestic violence, and the fact that on November 30, 2023, Latvia ratified the Council of Europe Convention on the prevention and combating violence against women and domestic violence (Istanbul Convention, 2011), which will enter into force on May 1, 2024, it is necessary to update the existing legal framework of the Republic of Latvia in relation to violence against women and domestic violence, improve the operation of the law enforcement system and eliminate gaps in the provision of rehabilitation services. The work consists of four chapters and six subsections, and its total volume is 71 pages. During the development of the work, the author of the work has found out that there is no joint cooperation model between the institutions. There is also no joint model for case registration, which makes it impossible to track the recurrence of cases, as most of the information is entered manually, which is time-consuming. Also, the author of the work has found out that the most widespread type of violence in Latvia is emotional violence, which is not criminalized. In the course of the work exhibition, the author of the work put forward six proposals that would contribute combating against violence.
