Valsts civildienesta ierēdņu disciplinārlietu izmeklēšanas un disciplināratbildības piemērošanas tiesiskie un praktiskie aspekti

Abstract

Maģistra darba “Valsts civildienesta ierēdņu disciplinārlietu izmeklēšanas un disciplināratbildības piemērošanas tiesiskie un praktiskie aspekti” mērķis ir, analizējot ierēdņu disciplināratbildības izvērtēšanas un disciplinārsoda piemērošanas procesus, identificēt nepilnības ierēdņu disciplināratbildību regulējošo normatīvo aktu piemērošanā. Jautājums par ierēdņu disciplinārlietu izmeklēšanas un disciplināratbildības piemērošanu ir tieši saistīts ar sabiedrības uzticēšanos valstij, kas Latvijā ir zems. Kopumā ir radīti priekšnoteikumi valsts pārvaldē nodarbināto darbinieku un ierēdņu disciplināratbildības izvērtēšanai, tomēr disciplināratbildības izvērtēšanas un piemērošanas nosacījumi ir atkarīgi no nodarbinātības tiesisko attiecību veida un iestādes ne vienmēr var savlaicīgi un pilnīgi noskaidrot pārkāpuma apstākļus un pieņemt lēmumus, lai sekmētu valsts pārvaldē nodarbināto atbildību un noteiktu, kādai ir jābūt iestādes rīcībai, lai pilnveidotu iekšējās kontroles vidi. Maģistra darbs sastāv no 3 nodaļām, sešām apakšnodaļām un tā apjoms ir 81 lpp.

The Master's work “legal and practical aspects of the investigation of disciplinary matters of State civil servants and the application of disciplinary liability” is to identify deficiencies in the application of the regulatory enactments regulating disciplinary liability of civil servants when analysing the procedures for evaluation of disciplinary liability of civil servants and the application of disciplinary punishment. The issue of the application of disciplinary investigation and disciplinary liability of civil servants is directly related to public trust in the state, which is low in Latvia. In general, the conditions for assessing the disciplinary liability of employees and officials employed in public administration have been created, but the conditions for assessing and applying disciplinary liability depend on the nature of the employment relationship and institutions may not always ascertain in a timely and complete manner the circumstances of the infringement and take decisions to promote the liability of employees employed in public administration and determine what action the institution must take to improve the internal control environment. The Masters consists of 3 chapters, six sub-chapters and is 81 pages in size.
