Abstract: | Maģistra darba tēma ir “Mikroliegumu tiesiskais regulējums un tā piemērošanas
problēmas”. Par temata aktualitāti liecina nepieciešamība izvērtēt pastāvošā normatīvā regulējuma
efektivitāti, kā arī tiesu prakse, statistikas rādītāji, un nepieciešamība nodrošināt vides aizsardzību.
Darbā tiks pētītas problēmas, kas saistītas ar mikroliegumu izveidi, to apsaimniekošanas kārtību,
aizsardzību, kā arī mikroliegumu un to buferzonas noteikšanu.
Maģistra darba mērķis ir izpētīt mikroliegumu normatīvo regulējumu, tā piemērošanas
kārtību, konstatēt problēmjautājumus un piedāvāt risinājumus.
Darbs sastāv no trim nodaļām. Pirmā nodaļa “Mikroliegums un tā izveides būtība” skaidro,
kāpēc ir nepieciešams veidot mikroliegumus, kas to izveides rezultātā tiek aizsargāts, kā arī tā
izveides vēsturiskie aspekti un statistikas dati mūsdienās. Otrā nodaļa “Mikroliegumu izveidošanas
un apsaimniekošanas kārtība, to aizsardzība, kā arī mikroliegumu un to buferzonu noteikšana”
sastāv no piecām apakšnodaļām – “Mikroliegumu noteikšanas kārtība”; “Mikroliegumu
izveidošanas kārtība”; “Mikroliegumu aizsardzība”; Mikroliegumu apsaimniekošanas kārtība”;
“Mikrolieguma teritorijas precizēšana vai tā statusa atcelšana”. Šajā nodaļā tiek izklāstīti, skaidroti
un analizēti spēkā esošie Ministru kabineta 2012.gada 18.decembra noteikumi Nr.940, kā arī
noskaidrots to izveides pamats un nepieciešamība turpmākai vides aizsardzībai. Trešajā nodaļā
“Mikrolieguma tiesiskā regulējuma piemērošanas prakse un ar to saistītā problemātika” tiek pētīta
tiesu prakse saistībā ar mikroliegumu izveidi, apsaimniekošanu, aizsardzību un noteikšanu, kā arī
kompensāciju apjomu un izmaksu personām, kuru īpašumā izveidots mikroliegums, meklēti un
izcelti galvenie problēmjautājumi esošajā normatīvajā regulējumā un tā piemērošanā.
Maģistra darbā secināts, ka nepieciešams papildināt un grozīt normatīvo regulējumu
saistībā ar mikroliegumu izveidošanas un apsaimniekošanas kārtību, to aizsardzību, kā arī
mikroliegumu un to buferzonu noteikšanu, lai tas pilvērtīgi un efektīvi nodrošinātu nepieciešamās
funkcijas atbilstoši šī brīža situācijai.
Maģistra darba kopējais apjoms ir 75 lpp.

The topicality of the topic is evidenced by the need to evaluate the effectiveness of the existing regulatory framework, as well as case law, statistical indicators, and the need to ensure environmental protection. The work will study the problems associated with the creation of micro-reserves, the procedure for their management, protection, as well as the establishment of micro-reserves and their buffer zone. The aim of the Master's thesis is to study the regulatory framework of micro-reserves, the procedure for its application, to identify problematic issues and offer solutions. The work consists of three chapters. The first chapter, “The micro-reserve and the essence of its creation”, explains why it is necessary to form micro-reserves, which are protected as a result of their creation, as well as the historical aspects of its creation and statistical data today. The second chapter, “Procedures for the establishment and management of micro-reserves, their protection, as well as the determination of micro-reserves and their buffer zones”, consists of five subsections – “The procedure for determining micro-reserves”; “The procedure for creating micro-reserves”; “Protection of micro-reserves”; “Procedures for the management of micro-reserves”; “Clarification of the territory of the micro-reserve or the abolition of its status”. This chapter presents, explains and analyzes the current Cabinet Regulation No.940 of 18.12.2012, as well as clarifies the basis for their creation and the need for further environmental protection. The third chapter, “Practice of applying the legal framework of micro-reserves and related problems”, examines case law related to the establishment, management, protection and determination of micro-reserves, as well as the amount and payment of compensation to persons in whose property a micro-reserve has been established, searches for and highlights the main issues in the existing regulatory framework and its application. The Master's thesis concludes that it is necessary to supplement and amend the regulatory framework in relation to the procedures for the establishment and management of micro-reserves, their protection, as well as the determination of micro-reserves and their buffer zones, so that it fully and efficiently provides the necessary functions in accordance with the current situation.
