Abstract: | Darbā “Personas tiesības uz informāciju un atbilde pēc būtības”, darba autore pēta tiesības uz informāciju un atbildi pēc būtības tiesisko regulējumu ta piemērošanu un ar to saistītos problēmjautājumus. Darba mērķis: analizējot tiesības uz informāciju un atbildi pēc būtības tiesisko regulējumu, un tā piemērošanu, konstatēt problemātiku, ieteikt veidu kā pilnveidot tiesības uz informāciju un atbildi pēc būtības tiesisko regulējumu.
Darba mērķa sasniegšanai tika izvirzīti šādi uzdevumi:
1) Izpētīt, privātpersona kā Latvijas Republikas Satversmē noteikto pamattiesību subjekts,
2) Izpētīt un analizēt tiesības uz informāciju ģenēzi,
3) Noskaidrot, infromācijas sagatavošanas un atbildes sniegšanas procesus,
4) Izpētīt, tiesu praksē paustās aktualitātes attiecībā uz tiesības uz informāciju un atbildi pēc būtības.
Darba izstrādes laikā darba autore secināja, ka iestādes neievēro labas pārlvaldības principus. Nepamatoti nosaka informācijai ierobežotas pieejamības statusu vides informācijai, tiesiskajā regulējumā ir liekvārdība, novecojušu, nekorektu terminu lietojums, liekvārdība. Tiesiskais regulējums neparedz iestādem atbildību par termiņu nokavējumiem atbildes sniegšanā,kā arī personai kuras tiesības ir aizskartas ir jāpierāda šo tiesību aizskārums.
Darbs ir apkopots 89 (atoņdesmit deviņās) lappusēs, satur 105 (simtu piecus) izmantotos avotus, kā arī 7 (septiņus) pielikumus. In the work "A person's right to information and substantive answer", the author of the work studies the right to information and an answer in substance, the application of the legal regulations and related problems. The purpose of the work: by analyzing the legal framework of the right to information and response and its application, identify problems, recommend a way to improve the legal framework of the right to information and response. To achieve the goal of the work, the following tasks were set: 1) Investigate, a private person as a subject of fundamental rights established in the Constitution of the Republic of Latvia, 2) Study and analyze the genesis of the right to information, 3) Clarify the processes of information preparation and response, 4) Investigate the actualities expressed in court practice regarding the right to information and a substantive answer. During the development of the paper, the author of the paper concluded that the institutions do not follow the principles of good governance. The status of limited access to information is unreasonably determined, the legal framework is redundant, the use of outdated, incorrect terms, redundant. The legal framework does not provide for the institution's responsibility for delays in the response, as well as the person whose rights have been violated must prove the violation of these rights. The work is compiled in 89 (eighty-nine) pages, contains 105 (one hundred-five) used sources, as well as 7 (seven) appendices. |
