Policijas lēmuma par nošķiršanu tiesiskais regulējums un piemērošanas problēmas

Abstract

Maģistra darba temats ir „Policijas lēmuma par nošķiršanu tiesiskais regulējums un piemērošanas problēmas”. Darba mērķis ir izpētīt vardarbības upura tūlītējā tiesību aizsardzības mehānisma tiesisko regulējumu, konstatēt problemātiku piemērošanā un ieteikt grozījumus tiesiskā regulējuma pilnveidošanai. Lai sasniegtu pētījuma mērķi tiek izvirzīti šādi uzdevumi: 1. Izpētīt un raksturot vardarbības jēdzienu un vardarbības draudu tūlītējas novēršanas aspektus; 2. Izpētīt un raksturot tūlītēju vardarbības draudu novēršanas tiesisko pamatojumu un iesaistīto institūciju kompetenci; 3. Izpētīt un analizēt normatīvo aktu nepilnības tūlītēju vardarbības draudu novēršanas sektorā, sniegt praktiskus priekšlikumus konstatēto nepilnību novēršanai. Darbs sastāv no 79 lapām, kas ietver trīs nodaļas. Darba pirmajā nodaļā autors ir noskaidrojis vardarbības jēdzienu un veidus, kā arī izpētījis tūlītēju vardarbības draudu novēršanas institūta attīstību Latvijā. Darba otrajā nodaļā autors sniedz ieskatu par normatīvo regulējumu tūlītējo vardarbības draudu novēršanas jomā, kā arī informācija par iestādēm, kuru kompetencē ir šo draudu novēršana, tai skaitā raksturojot informācija par policijas lēmumu par nošķiršanu kontroles pārsūdzības kārtību, kurai praksē ir būtiska loma tūlītēju vardarbības draudu novēršanā. Trešajā nodaļā tiek apskatīti Latvijas Republikas Satversmē noteikto cilvēka pamattiesību ierobežojumi, kas saistīti ar policijas lēmuma par nošķiršanu piemērošanu, kā arī nacionālo normatīvo aktu nepilnības tūlītējo vardarbības draudu novēršanas sektorā. Darbā izmantots 101 informācijas avots, gan akadēmiski, gan sabiedrisko procesu pētījumi, enciklopēdiski materiāli, nacionālie un ES tiesību normatīvie akti, vietējo un ārvalstu autoru monogrāfijas, zinātniskā literatūra, kā arī informācija ticamās interneta vietnēs. Izpēte veikta pamatā administratīvo tiesību ietvaros, galvenais izpētes objekts ir policijas darbu regulējošie tiesību akti.

The topic of the master's thesis is "Legal regulation and application problems of the police decision on separation". The aim of the work is to study the legal regulation of the immediate rights protection mechanism of the victim of violence, identify problems in application and develop recommendations how to improve the legal regulation. In order to achieve the aim of the research, the following tasks are set: 1. To research and characterize the concept of violence and the aspects of immediate prevention of the threat of violence; 2. Investigate and describe the legal basis for immediate prevention of threats of violence and the competence of the institutions involved; 3. To study and analyze the shortcomings of regulatory acts in the sector of prevention of immediate threats of violence, to provide practical proposals for the elimination of the identified shortcomings. The work consists of 79 pages that include three chapters. In the first chapter of the work, the author has clarified the concept and types of violence, as well as researched the development of the institute of the prevention of threats of violence in Latvia. In the second chapter of the work, the author provides an insight into the regulatory framework in the field of prevention of immediate threats of violence, as well as information about the institutions whose competence is to eliminate these threats, including describing information about the police decision on barring orders, control appeal procedure, which in practice plays a significant role in preventing immediate threats of violence. The third chapter examines the limitations of basic human rights stipulated in the Constitution of the Republic of Latvia, which are related to the application of the police decision on barring orders, as well as the shortcomings of national regulatory acts in the sector of immediate threats of violence. In the work used 101 information source, both academic and social researches, encyclopedic materials, national and EU laws and regulations, monographs by local and foreign authors, scientific literature, as well as information on reliable websites. The research was carried out mainly within the framework of administrative law, the main aim of research is the legal acts regulating police work.
