Bāriņtiesas kompetence mantojuma aizgādnībā - tiesiskais regulējums un problemātika

Abstract

ANOTĀCIJA

Autores maģistra darba mērķis ir aplūkot bāriņtiesas kompetenci mantojuma aizgādņa iecelšanā, tai skaitā noskaidrojot bāriņtiesas nepieciešamas veicamas darbības mantojuma aizgādņa kandidāta izvērtēšanā pirms iecelšanas, mantojuma aizgādņa atbrīvošanas un atcelšanas normatīvo regulējumu, kā arī izpētīt bāriņtiesas tiesības un pienākumus mantojuma aizgādņa uzraudzībā, norādot uz problēmaspektiem regulējumā. Maģistra darbu veido ievads, četras nodaļas, divas no kurām ir sadalītas apakšnodaļās, secinājumi un izmantotās literatūras saraksts. Autore darbā ir secinājusi, ka bāriņtiesai ar normatīviem aktiem ir uzlikta neraksturīga funkcija – juridiskas personas aizgādņa kontrole, kas prasa no bāriņtiesām ievērojamus resursus, kas būtu jāpatērē uz mazāk aizsargāto fizisko personu – nepilngadīgo un aizgādnībā esošo personu – interešu aizstāvībai. Maģistra darba izstrādes gaitā autore konstatēja, ka mantojuma aizgādņa iecelšanas un uzraudzības kontroles funkcijas ir sarežģītas, normatīvais regulējums ne vienmēr skaidrs un saprotams, kā arī trūkst metodiskie ieteikumi, tādējādi maģistra darbs var kalpot kā palīgavots bāriņtiesas darbiniekiem. Darba izstrādes gaitā tiek analizēti normatīvie akti, juridiskā literatūra un tiesu nolēmumi, tika noskaidrota bāriņtiesas pašreizējās prakses atbilstība tiesību normu prasībām.

ABSTRACT

The aim of the author's master's thesis is to examine the competence of the custody court in the appointment of the guardian of trusteeship of an estate, including clarifying the necessary actions of the custody court in evaluating the candidate for the guardian of trusteeship of an estate before appointment, the legal regulatory framework for the release and revocation of the guardian of trusteeship of an estate, as well as studying the rights and duties of the custody court in the supervision of the guardian of trusteeship of an estate, indicating the problematic aspects of the legal regulation. The master's thesis consists of an introduction, four chapters, two of which are divided into subsections, conclusions, and a list of references used. The author concludes that the custody court has been assigned an atypical function - the control of legal persons' guardianship, which requires significant resources from custody courts, which should be spent on the protection of the interests of less protected individuals - minors and persons under guardianship. During the development of the master's thesis, the author found that functions of the appointment and supervision control of the guardian of trusteeship of an estate are complex, the legal regulatory framework is not always clear and understandable, and there is a lack of methodological recommendations. Therefore, the master's thesis can serve as a helpful tool for custody court employees. The master's thesis analyzes legal acts, legal literature, and court orders, and determines the compliance of the current practice of the custody court with the requirements of legal norms.
