Kriminālatbildība par cietsirdīgu izturēšanos pret dzīvniekiem

Abstract

Maģistra darba temats ir “Kriminālatbildība par cietsirdīgu izturēšanos pret dzīvniekiem”. Cietsirdīgā izturēšanās pret dzīvniekiem vienmēr ir bijusi par nozīmīgu problēmu civilizētajā un attīstītajā sabiedrība, tomēr formējoties jauniem cilvēku uzskatiem, ka dzīvnieks tomēr ir dzīva būtne, nevis manta, būtu nepareizi minimizēt dzīvnieku veselības un dzīvības interešu nozīmīgumu. Darba autors uzskata, ka cietsirdīgas izturēšanās pret dzīvniekiem problēma ir daudzšķautņaina un tās pētīšana neaprobežojas tikai ar krimināltiesību izpēti, bet gan arī ar psiholoģijas, filozofijas un socioloģijas izpēti. Maģistra darba mērķis ir izpētīt jēdzienu “cietsirdīga izturēšanās pret dzīvniekiem” Krimināllikuma 230.panta kontekstā, izprast kādi ir šī noziedzīga nodarījuma kriminālatbildības priekšnoteikumi, kā arī izpētīt iespējamās problēmas, kas saistītas ar vainas pierādīšanu un sodu noteikšanu par šo noziedzīgu nodarījumu. Maģistra darba uzdevumi ir izpētīt jēdziena “cietsirdīga izturēšanās pret dzīvniekiem” terminoloģiskos aspektus, veikt cietsirdīgas izturēšanās pret dzīvniekiem noziedzīga nodarījuma sastāva elementu juridisko analīzi, izpētīt personas saukšanas pie kriminālatbildības par cietsirdīgas izturēšanās pret dzīvniekiem problemātiku, kā arī iespējamo noziedzīga nodarījuma nošķiršanu no administratīvā pārkāpuma, analizēt jaunāko tiesu praksi attiecībā uz cietsirdīgo izturēšanos pret dzīvniekiem un izpētīt ārvalstu normatīvos regulējumus attiecībā uz cietsirdīgo izturēšanos pret dzīvniekiem. Maģistra darba izstrādes un problēmsituāciju izpētīšanas laikā darba autors nonāca pie secinājuma, ka Krimināllikumā 230. pantā esošais formulējums un sods neatbilst mūsdienu realitātei un tas ir jāgroza. Maģistra darbs izstrādāts balstoties uz latviešu un ārzemju krimināltiesību autoru viedokļiem, Krimināllikumu, ārvalstu kriminālkodeksiem un Latvijas tiesu praksi. Darbs satur 76 lapas.

The topic of the master's thesis is "Criminal liability for cruel treatment of animals". Animal cruelty has always been a major problem in a civilized and developed society, but it would be wrong to minimize the importance of animal health and life in the emergence of new beliefs that animals are a living being and not property. The author believes that the problem of cruelty to animals is multifaceted and its research is not limited to the study of criminal law, but also to the study of psychology, philosophy and sociology. The aim of the master's thesis is to study the concept of "cruelty to animals" in the context of Section 230 of the Latvian Criminal Law, to understand the preconditions for criminal liability of this criminal offense, as well as to investigate possible problems related to proving guilt and sentencing. The tasks of the master's thesis are to study the terminological aspects of the concept of cruelty to animals, to perform a legal analysis of the elements of the crime of cruelty to animals, to investigate the problem of prosecuting a person for cruelty to animals, as well as the latest case law on cruelty to animals and to study foreign regulations on cruelty to animals. During the elaboration of the master's thesis and research of problem situations, the author of the work came to the conclusion that the wording and punishment in Article 230 of the Criminal Law do not correspond to modern reality and it needs to be amended. The master's thesis is based on the opinions of Latvian and foreign authors of criminal law, the Criminal Law, foreign criminal codes and the practice of Latvian courts. The work contains 76 pages.
