Ārstniecības riska fonda darbības efektivitātes novērtējums un ieteikumi darbības snieguma uzlabošanai

Abstract

Maģistra darba tēma ir “Ārstniecības riska fonda darbības efektivitātes novērtējums un ieteikumi darbības snieguma uzlabošanai”. Jebkuram cilvēkam ir tiesības saņemt kvalitatīvu un drošu veselības aprūpi, kā arī pieprasīt kompensāciju, ja tā netiek nodrošināta. 2013. gadā Latvijā tika izveidots Ārstniecības riska fonda (turpmāk tekstā “Fonds”), kura mērķis ir nodrošināt pacientiem pieejamu un saprotamu sūdzību iesniegšanas mehānismu ārpus-tiesas procesā. 2019. gadā Valsts kontroles revīzijā tika secināts, ka Fonda darbība neatbilst izveides mērķim. Valsts kontrole sniedza septiņus ierosinājumus, uz kuru pamata Fonda darbība tika pilnveidota. 2022. gadā Valsts kontrole Fonda darbību definēja kā mērķim atbilstošu, tomēr trūkst datu, kas to apliecinātu. Darbā izvirzīti seši uzdevumi, kuru ietvaros tika apkopota un analizēta informācija par: veselības aprūpes kvalitāti, medicīniskajām kļūdām, veselībai nodarīta kaitējuma kompensēšanas mehānismiem, organizācijas darbības efektivitātes novērtēšanas metodēm, Fonda līdzšinējo darbību un pacientu informētību. Minēto uzdevumu izpildei tika veikta zinātniskās literatūras, LR normatīvo aktu, ES direktīvu un interneta resursos pieejamās informācijas analīze, kā arī pilngadīgo Latvijas iedzīvotāju aptauja. Balstoties uz gūtajiem rezultātiem, sniegtas rekomendācijas Fonda darbības efektivitātes uzlabošanai. Pētījuma autore secina, ka Fonda darbības efektivitāte ir uzlabojusies, salīdzinot ar tā darbību pirms Valsts kontroles veiktās revīzijas, tomēr Fonda darbību joprojām nevar raksturot kā efektīvu un tā izveides mērķim atbilstošu. Iesniegto atlīdzības pieprasījumu administrēšanas process ir uzlabots, tomēr iedzīvotāji nav pārliecināti, kādos gadījumos vērsties Fondā būtu pamatoti. 24.8% aptaujāto iedzīvotāju ārstniecības procesā saskārušies ar situāciju, kurā, pēc viņa domām, bija pamats pieprasīt kompensāciju par veselībai nodarīto kaitējumu, tomēr tikai 7.1% iniciēja tālāku procesa virzību. Kopumā par Fonda darbību Latvijā dzirdējuši vien 27.4% aptaujāto iedzīvotāju. Pētījumā gūtie rezultāti var palīdzēt Fonda darbību realizējošajām institūcijām identificēt ar tā darbību saistītos problemātiskos aspektus un potenciālos risinājumus darbības efektivitātes uzlabošanai. The theme of the master’s thesis is “The assessment of the Medical Treatment Risk Fund’s performance efficiency and recommendations for its improvement”. Every person has the right to receive quality health care, as well as to request reimbursement should it not be provided. The Medical Treatment Risk Fund (henceforth “Fund”), established in Latvia in 2013, is meant to be an accessible and comprehensible out-of-court process for medical complaint submission. In 2019 The State Audit Office concluded that the ultimate goal of the Fund has not been met. Thus, it issued seven recommendations, on the basis of which the Fund's performance was improved. In 2022, The State Audit Office defined the Fund's activity as efficient; however, there is a lack of data to confirm this statement. The thesis has six objectives, which entail data collection and analysis on: the quality of healthcare, medical errors, reimbursement mechanisms for adverse events in healthcare, methods for evaluating the organization's performance, patient awareness and the previous activities of the Fund. In order to fulfill the objectives, the author conducted an analysis of academic sources, legislative regulation, EU Directives and information available in Internet resources, while carrying out a survey of the adult population of Latvia. Based on the results obtained, recommendations for improving the efficiency of the Fund's performance were developed. The author concludes that the Fund's performance has improved compared to what it was prior the audit, however, it cannot be described as efficient and consistent with the Fund’s objective. The process of administering patient claims for reimbursement has been improved, yet patients are uncertain of situations when seeking compensation with the Fund may be seen as justified. 24.8% of the surveyed population reported encountering an adverse healthcare event resulting in negative consequences; however, only 7.1% initiated the reimbursement process. In addition, only 27.4% of the respondents had ever heard about the Fund. The results obtained in the study can help the institutions implementing the Fund's activities to identify the problematic aspects regarding its performance and potential opportunities for improvements.
