Abstract: Maģistra darba tēmas aktualitātes pamatā ir atziņa, ka naida noziegumi skar ne tikai konkrētu cilvēku vai cilvēku grupu, pret kuriem vērsti noziegumu, bet sabiedrību kopumā, radot draudus sabiedrības un valsts drošībai. Maģistra darbā “Naida noziegumu krimināltiesiskais raksturojums” ir veikta naida noziegumu, naida runas jēdziena analīze, lai izprastu tās saturu. Darba ietvaros ir veikta Krimināllikumā esošo pantu izskatīšana, veicot noziedzīgo nodarījumu sastāvu analīzi. Darba ietvaros bija nepieciešams uzzināt ārvalstu tiesisko regulējumu sasaistot ar Latvijas Krimināllikumu. Darba mērķis ir izpētīt naida noziegumu kā noziedzīgu nodarījumu sastāvu, kvalificējošās pazīmes, to nozīmi un piemērojamību. Maģistra darba objekts krimināltiesiskās attiecības, kas saistītas ar naida noziegumu nodarīšanu un to kvalifikācija. Maģistra darba priekšmets ir spēkā esošās likuma normas, kas nosaka atbildību par naida noziegumiem un to piemērošana. Darbs sastāv no piecām nodaļām. Darba pirmajā nodaļā tiek aplūkots naida nozieguma un naida runas jēdziens un atbildības par to regulējuma vēsturiskais aspekts. Otrā nodaļa veltīta naida sastāva analīzei. Trešajā nodaļā tiek izpētīts naida motīvs kā atbildību pastiprinošs apstāklis. Ceturtajā nodaļā plašākai krimināltiesību izpētei darba autore izskatīja ārvalstu krimināltiesību normas. Savukārt piektajā nodaļā ir analizēta tiesu prakse. Maģistra darba rezultātā, autore nonāk pie priekšlikumiem paplašināt likuma normas par naida noziegumiem ar citu personu grupu iekļaušanu dispozīcijā un paplašināt atbildības pastiprinoša apstākļa normu ar citu personu grupu iekļaušanu. Kā arī darba autore nonāk pie priekšlikuma pielīdzināt atbildību par naida izraisīšanu neatkarīgi no diskriminētas grupas. Maģistra darbs sastāv no deviņdesmit trim lapaspusēm, anotācijas latviešu un itāļu valodā, ievada, piecām nodaļām un sešām apakšnodaļām, nobeiguma, kas ietver sevī secinājumus un priekšlikumus, un izmantoto avotu un bibliogrāfijas saraksta. Darbā izmantoti astoņdesmit divi informācijas avoti gan latviešu valodā, gan svešvalodā. Maģistra darbā tiek izmantoti tiesību akti, tiesību zinātnieku atziņas, elektroniskie resursi, Latvijas tiesu spriedumi.
The topic of the master's thesis is based on the realization that hate crimes affect not only a specific person or group of people against whom the crime is directed, but society as a whole, creating a threat to the security of society and the state. In the master's thesis "Criminal law characterization of hate crimes", an analysis of the concept of hate crimes, hate speech has been carried out in order to understand its content. Within the framework of the work, consideration of the articles of the Criminal Law has been carried out, an analysis of the composition of criminal offenses has been carried out. Within the framework of the work, it was necessary to learn the foreign legal framework by linking it with the Latvian Criminal Law. The purpose of the work is to study the composition, qualifying features of hate crimes as criminal offenses, their meaning and applicability. The object of the master's thesis criminal legal relations related to the infliction of hate crimes and their qualification. The subject of the master's thesis is the existing norms of the law that establish responsibility for hate crimes and their application. The work consists of five chapters. The first chapter of the work deals with the concept of hate crime and hate speech and the historical aspect of the regulation of responsibility for it. The second chapter is devoted to the analysis of the composition of hatred. Chapter three explores the motive of hatred as an aggravating circumstance. In the fourth chapter, for a broader study of criminal law, the author of the work considered the norms of foreign criminal law. In turn, the fifth chapter analyzes judicial practice. As a result of the master's thesis, the author comes to proposals to expand the norms of the law on hate crimes with the inclusion of other groups of persons in the disposition and to expand the norm of an aggravating circumstance with the inclusion of other groups of persons. As well as the author of the work comes to the proposal to equate responsibility for inciting hatred, regardless of the discriminated group. The master's thesis consists of ninety-three pages, annotations in Latvian and Italian, An Introduction, five chapters and six subsections, a final, which includes conclusions and proposals, and a list of used sources and bibliography. The work uses eighty-two sources of information both in Latvian and in a foreign language. The master's thesis uses legal acts, knowledge of legal scholars, electronic resources, judgments of Latvian courts.
L'argomento della tesi del master si basa sulla consapevolezza che i crimini d'odio colpiscono non solo una persona specifica o un gruppo di persone contro le quali è diretto il crimine, ma la società nel suo complesso, creando una minaccia per la sicurezza della società e dello stato. Nella tesi di master " Caratterizzazione penale legale dei crimini d'odio ", un'analisi del concetto di crimini d'odio, incitamento all'odio è stata effettuata al fine di comprenderne il contenuto. Nell'ambito del lavoro, è stata effettuata l'esame degli articoli del diritto penale, è stata effettuata un'analisi della composizione dei reati penali. Nell'ambito del lavoro, è stato necessario apprendere il quadro giuridico straniero collegandolo al diritto penale lettone. Lo scopo del lavoro è studiare la composizione, qualificare le caratteristiche dei crimini d'odio come reati penali, il loro significato e applicabilità. L'oggetto della tesi di master rapporti giuridici penali relativi all'inflizione di crimini d'odio e alla loro qualificazione. L'argomento della tesi del master sono le norme esistenti della legge che stabiliscono la responsabilità per i crimini d'odio e la loro applicazione. Il lavoro è composto da cinque capitoli. Il primo capitolo del lavoro affronta il concetto di crimine d'odio e incitamento all'odio e l'aspetto storico della regolamentazione della responsabilità per esso. Il secondo capitolo è dedicato all'analisi della composizione dell'odio. Il terzo capitolo esplora il motivo dell'odio come circostanza aggravante. Nel quarto capitolo, per uno studio più ampio del diritto penale, l'autore del lavoro ha considerato le norme del diritto penale straniero. A sua volta, il quinto capitolo analizza la pratica giudiziaria. Come risultato della tesi di master, l'autore arriva a proposte per espandere le norme della legge sui crimini d'odio con l'inclusione di altri gruppi di persone nella disposizione e per espandere la norma di una circostanza aggravante con l'inclusione di altri gruppi di persone. Così come l'autore del lavoro arriva alla proposta di equiparare la responsabilità di incitare all'odio, indipendentemente dal gruppo discriminato. La tesi di master è composta da novantatré pagine, annotazioni in lettone e italiano, Un'Introduzione, cinque capitoli e sei sottosezioni, una finale, che include conclusioni e proposte, e un elenco di fonti e bibliografia utilizzate. Il lavoro utilizza ottantadue fonti di informazione sia in lettone che in una lingua straniera. La tesi del master utilizza atti giuridici, conoscenza di studiosi legali, risorse elettroniche, sentenze dei tribunali lettoni.
