Abstract

Maģistra darba tēma ir „Lietu par bērnu prettiesisku pārvietošanu pāri robežai juridiskā problemātika”. Maģistra darbā ir pētīts jautājums par starptautisko un Eiropas Savienības juridisko instrumentu mijiedarbību un piemērošanu praksē attiecība uz bērnu prettiesisku pārvietošanu pāri robežai, tiecoties uz risinājumiem par bērna dzīvesvietas noteikšanu, bērna viedokļa nozīmīguma izprašanu, kā arī bērna atgriešanas vai neatgriešanas pamatiem un problēmjautājumiem, kas skar šo tēmu. Maģistra darba mērķis ir, izanalizējot tiesu praksi un starptautisko, kā arī nacionālo normatīvo aktu regulējumu lietu par bērnu prettiesisku pārvietošanu pāri robežai, identificēt tiesiskās problēmas un ieteikt risinājumus. Bērna prettiesiskas aizvešanas vai aizturēšanas civiltiesisko aspektu regulējums ir atkarīgs no dažādu tiesību aktu savstarpējās mijiedarbības. Kaut gan bērna prettiesiskas aizvešanas un aizturēšanas gadījumus galvenokārt regulē 1980.gada Hāgas konvencija un Briseles IIter regula, tomēr piemērojot tās, ir nepieciešams skatīt arī Eiropas Savienību tiesību aktus, kā arī nacionālos tiesību aktus. Maģistra darbs sastāv no 4 nodaļām, kuras iedalītas arī apakšnodaļās, kas kopā veido 96 lapaspuses.

The work of the Master has examined the issue of the interaction and application of international and European Union legal instruments in practice to the illegal transfer of children across the border, seeking solutions to determine the child's place of residence, the expiration and importance of the importance of the child's opinion, as well as the resolution of the child's return or non-return issues and the issues of concern. The aim of the Master's work is to identify legal problems and recommend solutions when analyzing judicial practice and the regulation of international, as well as national laws, regulations on the illegal movement of children across the border. The regulation of the civil aspects of the child's unlawful removal or detention depends on the interplay between different laws. Although the cases of unlawful removal and detention of the child are mainly governed by the Hague Convention of 1980 and the Brussels IIter Regulation, it is necessary to see European Union legislation as well as national law when applying them. The work of the Master consists of 4 chapters, which are also divided into subdivisions, which together form 96 pages.
