Kolektīvās imunitātes nodrošināšanas tiesiskie aspekti un problemātika

Abstract

Maģistra darba tēma ir “Kolektīvās imunitātes nodrošināšanas tiesiskie aspekti un problemātika”. Darba mērķis ir izpētīt kolektīvās imunitātes būtību, raksturojot tās nozīmību sabiedrības veselības nodrošināšanā un ilgtspējā un, izvērtējot tiesisko regulējumu, konstatēt problēmjautājumus un piedāvāt to risinājumu iespējas. Kolektīvā imunitāte un tās nodrošināšanas tiesiskie aspekti pēdējo gadu laikā aktualizējuši jautājumus par indivīda pamattiesību ierobežošanas samērīgumu, pretstatā nostādot sabiedrības ieguvumu no kolektīvās imunitātes. Darbā pētīta kolektīvā imunitāte kā sabiedrības ilgtspējas pamats un ar to saistītie tiesiskie aspekti. Indivīda tiesību ierobežošana, kas tiek pamatota ar sabiedrības kopējo ieguvumu no kolektīvās imunitātes. Kolektīvās imunitātes nodrošināšanas praktiskie aspekti Latvijā, kur analizētas problēmas gan sabiedrībās ietvaros, gan valsts ietvaros kolektīvās imunitātes nodrošināšanā. Pētījumā autors analizējis tiesību aktus, kas regulē kolektīvās imunitātes veidošanu, Eiropas Cilvēktiesību tiesas tiesu praksi obligātās vakcinācijas lietās un tiesībzinātnieku atziņas. Darbā autors konstatē kolīziju starp diviem nacionālajiem tiesību aktiem, no kuriem vienā vakcinācija tiek noteikta kā obligāta dažādām sabiedrības grupām, bet otrā personai tiek dota izvēle lemt par vakcinācijas veikšanu. Pētījuma rezultātā tiek secināts, ka Latvijas tiesiskais regulējums vakcinācijas jautājumos ir nepilnīgs un autors sniedz priekšlikumus tā pilnveidei. The topic of the Master's thesis is “Legal aspects and problems of the provision of herd immunity”. The aim of the work is to explore the substance of collective immunity, characterizing its importance in the provision and sustainability of public health and, in evaluating the legal framework, identifying issues and offering options for their solutions. Herd immunity and legal aspects of its provision have in recent years raised issues regarding the proportionality of the limitation of the rights of the individual, in contrast to the public benefit from collective immunity. The theses explored herd immunity as the basis of public sustainability and related legal aspects. Limitation of the rights of the individual, which is justified by the total benefit of the company from herd immunity. Practical aspects of the provision of herd immunity in Latvia, where problems have been analysed both within the framework of societies and within the framework of the State in ensuring herd immunity. In the research, the author analysed the legislation governing the formation of collective immunity, the jurisprudence of the European Court of Human Rights in compulsory vaccination cases and the researches of law scientists. The author establishes a conflict between two national legislation, one in which vaccination is defined as compulsory for different groups of society, while in the second legislation person is given a choice to decide on the conduct of vaccination. As a result of the study, it is concluded that the legal framework for vaccination is incomplete and the author makes proposals for its refinement.
