Labas likumdošanas principa nozīme likumdošanas procesā

Abstract

Maģistra darba tēma ir “Labas likumdošanas principa nozīme likumdošanas procesā” un tā mērķis ir - analizējot labas likumdošanas principa kā vispārējā tiesību principa attīstību Latvijas tiesiskajā sistēmā un tā piemērošanu likumdošanas procesā, konstatēt problēmas un ieteikt iespējamos risinājumus labas likumdošanas nodrošināšanai. Tiesiskās kārtības, drošības un stabilitātes nodrošināšanai demokrātiskā valstī ir nepieciešams tāds likumdošanas process, kas veicina sabiedrības uzticēšanos valstij un tiesībām, kā arī uzlabo demokrātiska procesa izpratni sabiedrībā. Tādējādi likumdošanas procesa kvalitātes pilnveidošana un attiecīgi kvalitatīvs normatīvais regulējums sabiedrībā vienmēr ir bijis aktuāls jautājums. Maģistra darba ietvaros pētīta labas likumdošanas principa kā vispārējā tiesību principa ģenēze, sniegts ieskats par labas likumdošanas nodrošināšanas principiem Eiropas Savienībā, kā arī atbilstoši Satversmes tiesas spriedumos paustajām atziņām analizēti labas likumdošanas principa satura veidojošie elementi. Darba gaitā secināts, ka demokrātiskas tiesiskas valsts tiesiskajā sistēmā vispārējie tiesību principi tiek atvasināti no pamatnormas, kas nosaka valsts tiesiskās sistēmas saturu, un likumdevējam ir pienākums tos ievērot likumdošanas procesā. Tiesību principi tiek konkretizēti un nostiprināti arī tiesu darbības rezultātā. Kopš 2019.gada Satversmes tiesa ir konkretizējusi labas likumdošanas principu kā Latvijas tiesiskajā sistēmā pastāvošu vispārējo tiesību principu. Labas likumdošanas principa ievērošana likumdošanas procesā nodrošina, ka sabiedrībā veidojas pārliecība, ka likumdevēja izraudzītais risinājums ir tiesisks, taisnīgs un samērīgs, un veicina personu uzticēšanos valstij un tiesībām. The topic of the Master's Thesis is “The Importance of the Principle of Good Legislation in the Legislative Process" and its purpose is - analysing the development of the Principle of Good Legislation as the principle of general law in the Latvian legal system and its application in the legislative process, identify problems and possible solutions for ensuring good legislation. Ensuring legal order, security and stability in a democratic country requires a legislative process that promotes public trust in the state and rights, as well as improves the understanding of the democratic process in society. Thus, improving the quality of the legislative process and, accordingly, high-quality normative regulation in society has always been a topical issue. Within the framework of the Master's Thesis, the origin in formation of the Principle of Good Legislation as the general principle of law is studied, an insight into the principles of ensuring better legislation in the European Union is provided, and the elements forming the content of the principle of good legislation are analysed in accordance with the findings expressed in the judgments of the Constitutional Court. It was concluded that in the legal system of a democratic legal state the general principles of law are derived from the basic norm, that determine the content of the national legal system, and the legislator is obliged to comply in the legislative process with them accordingly. The principles of law are also specified and strengthened as a result of judicial action. Since 2019, the Constitutional Court has specified the Principle of Good Legislation as the general principle of law in the legal system of Latvia. Compliance with the Principle of Good Legislation in the legislative process ensures that society develops confidence that the solution chosen by the legislator is legal, fair, proportionate and promotes the trust of individuals in the state and law. The Master's Thesis consists of three chapters and its total volume is 101 pages.
