Pagaidu aizsardzības pret vardarbību tiesiskais regulējums un tā piemērošanas praktiskās problēmas.

Abstract

Maģistra darbā tiek pētīts pagaidu aizsardzības pret vardarbību tiesiskais regulējums un ar tā piemērošanu saistītās problēmas. Pieaugot pieņemto pagaidu aizsardzības pret vardarbību lēmumu skaitam, ar vien aktuālāks paliek jautājums par nepamatoti iesniegtu pieteikumu novēršanu, cietušās personas un varmākas tiesību samērīguma izvērtējuma trūkumu pieņemot pagaidu aizsardzības pret vardarbību lēmumus. Ņemot vērā, ka pagaidu aizsardzības pret vardarbību normas Latvijā ir salīdzinoši jauns tiesību mehānisms, šobrīd tā piemērošanā vēl ar vien vērojams vienotas prakses trūkums un piemērošanas problēmas, kas saistīts ar nepareizu pagaidu aizsardzības pret vardarbību normu mērķa noteikšanu. Maģistra darba mērķis ir izpētot Civilprocesa likumā un citos pagaidu aizsardzības pret vardarbību reglamentējošos normatīvajos aktos paredzētos regulējumus, un pastāvošās problēmas, noskaidrot tiesiskā regulējuma piemērošanas problēmas, kā arī sniegt iespējamos risinājumus tiesību normu pilnveidei. Maģistra darbā tiek noskaidrots, kas ir vardarbība un sniegts ieskats pagaidu aizsardzības pret vardarbību institūta attīstībā. Savukārt turpmākajās maģistra darba nodaļās tiek noskaidrota pagaidu aizsardzības pret vardarbību piemērošanas kārtība, analizēts tā tiesiskais regulējums un praksēs esošās problēmas, kas saistītas gan ar pagaidu aizsardzības pret vardarbību nodrošināšanu, gan samērīguma ievērošanu attiecībā uz iesaistīto personu cilvēktiesībām. Sasniedzot maģistra darba mērķi un izpildot uzdevumus, nobeigumā tiek izdarīti secinājumi un izteikti priekšlikumi par maģistra darba izstrādes laikā konstatēto problēmu risināšanai un tiesiskā regulējuma pilnveidošanai. Maģistra darbu veido ievads, trīs nodaļas, trīs apakšnodaļas, nobeigums un izmantoto avotu un bibliogrāfijas saraksts, kopējais lappušu skaits ir 90.

The Master's Thesis examines the legal framework of temporary protection against violence and the problems related to its application. As the number of decisions on temporary protection against violence increases, the issue of preventing unjustified applications and the lack of proportionality between the rights of the victim and the rights of the perpetrator in the adoption of temporary protection against violence decisions becomes more and more pressing. Given that the rules on temporary protection against violence are a relatively new legal mechanism in Latvia, there is still a lack of uniform practice in its application and problems with its application due to incorrect definition of the purpose of the rules on temporary protection against violence. The aim of the Master's thesis is to clarify the problems of application of the legal regulation, as well as to provide possible solutions for improvement of the legal norms by studying the regulations and existing problems in the Civil Procedure Law and other normative acts regulating temporary protection against violence. The Master's Thesis defines what violence is and gives an insight into the development of the institution of temporary protection against violence. The following chapters of the Master's Thesis clarify the procedure for applying temporary protection against violence, analyze its legal framework and the problems encountered in practice, both with regard to the provision of temporary protection against violence and the respect of proportionality with regard to the human rights of the persons involved. Having achieved the aim and objectives of the Master's Thesis, the conclusions are drawn and proposals are made for solving the problems identified during the elaboration of the Master's Thesis and for improving the legal framework. The Master Thesis consists of an introduction, three chapters, three sub-chapters, a conclusion and a list of sources and bibliography; the total number of pages is 90.
