Noziedzīgu nodarījumu alkoholisko dzērienu aprites jomā kvalifikācijas problēmas

Abstract

Maģistra darba tēma “Noziedzīgu nodarījumu alkoholisko dzērienu aprites jomā kvalifikācijas problēmas” ir aktuāla tēma mūsu valstī. Darba ievadā tiek pamatota izvēlētās tēmas aktualitāte, formulēts pētījuma mērķis, pētījuma jautājumi un noteikti pētījuma uzdevumi. Darba mērķis ir izpētīt Krimināllikumā paredzēto atbildību alkoholisko dzērienu aprites jomā un izzināt kvalifikācijas problēmas, analizējot alkohola aprites tiesisko regulējumu, piemērošanas praksi, problemātiku un ieteikt risinājumus. Sakarā ar iepriekš minēto mērķi tiek uzstādīti vairāki uzdevumi - apskatīt terminoloģiskos aspektus alkoholisko dzērienu aprites jomā, izpētīt noziedzīga nodarījuma sastāvu un kvalificējošās pazīmes par pārkāpumiem alkohola aprites jomā un izanalizēt tiesu praksi par noziedzīgiem nodarījumiem nelikumīgā alkohola aprites jomā. Pētījuma objekts ir krimināltiesiskās attiecības saistībā ar pārkāpumiem alkohola aprites jomā. Maģistra darba pētījuma priekšmets - pārkāpumu alkohola aprites jomā tiesiskais regulējums. Darba izstrādes gaitā tika analizēti tiesību akti, kas regulē alkohola apriti, kā arī paredz atbildību par nelikumīga alkohola apriti, juridiskā literatūra, dažādi interneta resursi un tiesu prakses materiāli. Darba izstrādes gaitā tika pielietotas vairākas pētniecības metodes: analītiskā pētniecības metode, deskriptīvā pētniecības metode, deduktīvā pētniecības metode, induktīvā pētniecības metode, tiesību normu interpretācijas metodes (gramatiskā metode, vēsturiskā metode, sistēmiskā metode un teleoloģiskā metode). Maģistra darbs tiek strukturēts: anotācija, saturs, ievads, trīs nodaļas, kas ietver teorētisko un pētniecisko daļu, nobeigums, izmantotās literatūras un avotu saraksts.

Master's theme “Qualification problems of criminal offenses in the field of circulation of alcoholic beverages” is a topical theme in our country. The work introduction supports the focus of the selected topic, sets out the purpose of the study, questions of the study, and sets out the objectives of the study. The aim of the work is to explore the responsibility of the Criminal Law in the field of the circulation of alcoholic beverages and to explore skills problems by analysing the legal framework for the circulation of alcohol, application practices, problems and recommending solutions. Acording above objectives, a number of objectives are being set up to examine the terminological aspects of the movement of alcoholic beverages, to investigate the composition of a criminal offence and to investigate the qualifying features of alcohol offences and to analyse the case law on illegal alcohol offences. The subject of the study is criminal relations in relation to alcohol offences. Subject of the Master's is legal framework for alcohol offences. During of work, the legislation governing the circulation of alcohol was analysed as well as the responsibility for the trafficking of illegal alcohol, legal literature, various internet resources and case-law materials. In the course of the work development, a number of research methods were used, a cryptional research method. a deductive research method, an inductive research method, methods of interpretation of legal norms (grammatical method, historical method, systemic method and teleological method. Master's work is structured: annotation, content, introduction, three chapters – theoretical and research part, final, table of literature and sources used.
