Abstract
ANOTĀCIJA
Bakalaura darba tēma ir “Pacienta pārstāvības tiesiskā regulējuma problemātika”. Darbs sastāv no ievada, trīs nodaļām, septiņām apakšnodaļām un nobeiguma.
Minētā pētījuma aktualitāte ir saistāma ar to, ka esošais regulējums attiecībā uz pacienta pārstāvību ārstniecībā nav pilnvērtīgs. Pirmkārt, tas nereglamentē pacienta tiesības pilnvarot citu personu viņa vietā pieņemt ar ārstniecību saistītus lēmumus īstenošanas kārtību Pacientu tiesību likuma 6.panta septītās daļas izpratnē. Otrkārt, paredzot pilnvarojuma ierakstu veselības nozares elektroniskajā informācijas sistēmā, ir nepieciešams veikt grozījumus Ministru kabineta 2014.gada 11.marta noteikumos Nr. 134 “Noteikumi par vienoto veselības nozares elektronisko informācijas sistēmu”, tādējādi novēršot tiesību normu kolīziju. Treškārt, iekļaujot nākotnes pilnvarojuma veidu civiltiesiskajā regulējumā, likumdevējs nav veicis grozījumus Pacientu tiesību likumā attiecībā uz nākotnes pilnvarojuma īstenošanu ārstniecībā, līdz ar ko pacientu tiesības netiek īstenotas nepilnvērtīga regulējuma dēļ. Ceturtkārt, līdz ar starptautisko dokumentu, piemēram, ANO Konvencijas par personu ar invaliditāti tiesībām, Konvencijas par cilvēktiesību un cieņas aizsardzību bioloģijā un medicīnā ratifikāciju, valsts uzņēmās par pienākumu garantēt tajā noteikto personu tiesību aizsardzību un īstenošanu. Neparedzot aizgādnībā esoša pacienta tiesību saturisku atspoguļošanu Pacientu tiesību likumā, netiek izpildīti starptautiskā regulējuma nosacījumi nacionālā līmenī. Cita starpā bakalaura darba ietvaros tiks analizēta tiesību normu korelācija starp Pacientu tiesību likumu un speciālajiem likumiem attiecībā uz pacienta pilnvarojuma, tādējādi arī pārstāvības institūtu ārstniecībā, piemēram, Cilvēka genoma izpētes likumā, likumā “Par miruša cilvēka ķermeņa aizsardzību un cilvēka audu un orgānu izmantošanu medicīnā”, Fizisko personu reģistra likumā.
Bakalaura darba mērķis ir izpētot pacienta tiesības uz pārstāvību, konstatēt tiesiskā regulējuma nepilnības, izstrādāt priekšlikumus pacienta pārstāvības tiesiskā regulējuma pilnveidei.
Kopējais darba apjoms ir 68 lappuses.
ABSTRACT The topic of the bachelor’s thesis is The Problematics in the Legal Framework for Representation of Patients. The thesis consists of an introduction, three chapters, seven sub-chapters and conclusion. The topicality of the mentioned research is related to the fact that the existing regulation regarding representation of a patient in the medical treatment is not complete. Firstly, it fails to regulate the right of a patient to authorize another person to take decisions related to medical treatment on his/her behalf within the meaning of Paragraph seven of Section 6 of the Law on the Rights of Patients. Secondly, providing for the entry of authorization in the Electronic Information System of the Health Sector, it is required to make amendments to the Regulation of the Cabinet of Ministers No. 134 Regulations Regarding the Unified Electronic Information System of the Health Sector, thus preventing conflict of laws. Thirdly, upon inclusion of the type of future authorization in the civil law regulation, the legislator failed to amend the Law on the Rights of Patients regarding the implementation of the future authorization in medical treatment, thereby the patients’ rights are not implemented due to inadequate regulation. Fourthly, with the ratification of international instruments such as the UN Convention on the Rights of Persons with Disabilities and the Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine, the State undertook to guarantee protection and exercising of the rights of persons referred to therein. Failing to provide for the substantive reflection of the rights of a patient, who is under guardianship, in the Law on the Rights of Patients, the conditions of the international regulation are not fulfilled at the national level. Among other things, the bachelor’s thesis will deal with the analysis of the correlation between the Law on the Rights of Patients and special laws regarding the institute of patient authorization, thus also representation in the medical treatment, such as the Human Genome Research Law, the Law on the Protection of the Body of Deceased Human Beings and the Use of Human Tissues and Organs in Medicine, Law on the Register of Natural Persons. The aim of the bachelor’s thesis is to research the patient’s right to representation, to identify shortcomings of the legal regulation, to develop proposals for improvement of the regulatory framework regarding patient representation. The total volume of the thesis is 68 pages.
