Maģistra darbs ir veltīts parādnieka pienākumu fiziskas personas maksātnespējas procesā izpētīšanai un tiesiskā regulējuma piemērošanas Latvijas Republikā izzināšanai, vienlaikus izvērtējot konkrētus problēmjautājumus un izvirzot priekšlikumus to risināšanai.
Izpētot fiziskas personas maksātnespējas procesa norisi un nozīmi, kā arī parādnieka pienākumus šajā procesā, secināts, ka, lai nodrošinātu kreditoru tiesības uz prasījuma apmierinājumu, kā arī, lai veicinātu maksātnespējas procesa pieteikumu un lietu efektīvu un taisnīgu izskatīšanu tiesā, nepieciešams konkretizēt parādnieka pienākumus fiziskas personas maksātnespējas procesā, kā arī paredzēt papildu pienākumus. Vienlaikus secināts, ka maksātnespējas procesā veicamie pienākumi jāpadara parādniekam iespējami skaidri, lai parādnieks tos varētu izpildīt bez nepieciešamības vērsties pēc juridiskās palīdzības to izskaidrošanai vai īstenošanai.
Darbam ir 83 lappuses, tas sastāv no četrām nodaļām ar apakšnodaļām.
The master's thesis is dedicated to the study of the obligations of the debtor in the insolvency process of a natural person and to the application of the legal framework in the Republic of Latvia, while evaluating specific problematic issues and putting forward proposals for their solution. After studying the procedure and importance of the insolvency process of a natural person, as well as the obligations of the debtor in this process, it was concluded that in order to ensure the creditors’ rights, as well as to promote the effective and fair consideration of insolvency process applications and cases in court, it is necessary to specify the debtor's obligations for natural persons in the insolvency process, as well as provide for additional obligations. At the same time, it was concluded that the obligations to be performed in the insolvency process should be made as clear as possible to the debtor, so that the debtor could fulfill them without the need to seek legal assistance for their explanation or implementation. The master's thesis consists of 83 pages, four chapters with subsections.
