Abstract
Latvijā joprojām darba devēji neietver darba līgumos visas Darba likumā ietvertas prasības gan uz darba līguma saturu, gan uz formu. Pie tam, darba devēji iekļauj darba līgumā nosacījumus, kas ir pretrunā Darba likumam. Arī pēc Valsts darba inspekcijas datiem 2018.gadā darba devēji visbiežāk nav ievērojuši Darba likuma 40.pantā ietvertas prasības, kuru pārkāpumi veido 30% no visiem darba tiesisko attiecību pārkāpumiem.
Bakalaura darba mērķis ir izpētīt darba līguma satura tiesisko regulējumu un darba līguma nošķiršanas kritērijus no līdzīgiem civitiesiskiem līgumiem, apskatīt tiesu praksi šājos jautājumos, noskaidrot iespējamus problēmjautājumus un izteikt savus priekšlikumus risinājumiem.
Pētot minētos jautājumus, autore secināja, ka nepieciešams precizēt normatīvo regulējumu.
Bakalaura darbs sastāv no 129 lapām.
Employers in Latvia still do not include all the requirements contained in the Labor Law in employment contracts, both in terms of the content and form of the employment contract. In addition, employers include in the employment contract conditions that are in conflict with the Labor Law. According to the data of the State Labor Inspectorate, in 2018, employers most often did not observe the requirements included in article 40 of Labor Law, violations of which make up 30% of all violations of employment relations. The aim of Bachelor’s thesis is to study the legal regulation of the content of the employment contract and the criteria for distinguishing the employment contract from similar civil contracts, to review the case law on these issues, to find out possible problems and to make solution proposals. While doing the research on the mentioned issues, the author concluded that it is necessary to clarify the regulatory framework. The Bachelor’s thesis consists of 129 pages.
