Apbūves tiesības un ar to saistītā problemātika

Abstract

Tēmas aktualitātes pamatā ar atziņu, ka tikai tad ir nozīme izstrādāt un pieņemt jaunu apgrūtinājuma veidu, ja tas ir nepieciešams sabiedrībai un indivīdam. Maģistra darbs „ Apbūves tiesības un ar to saistītā problemātika” ir veidots, lai darba ietvaros tiktu izpētīti visi būtiskie tiesiskā regulējuma aspekti. Maģistra darba mērķis ir izpētot apbūves tiesību regulējumu, konstatēt problēmjautājumus un izvirzīt priekšlikumus tās tiesiskā regulējuma pilnveidošanai. Pētījuma rezultātā gūtā galvenā atziņa ir tā, ka, lai sekmētu apbūves tiesību izmantošanu, ir jāpilnveido tiesiskais regulējums Maģistra darbs sastāv no trīs nodaļām. Darbā tiek izmantoti tiesību akti, tiesību zinātnieku atziņas, publikācijas pētāmajā jautājumā, kā arī tiesas spriedumi.The focus of the topic is based on the recognition that it is only then important to develop and accept a new form of burden when it is necessary for society and the individual. The Master's work on “Building rights and related challenges” is designed to explore all relevant aspects of the legal framework within the work. The aim of the Master's work is to explore the regulation of building rights, identify challenges and put forward proposals to improve its legal framework. The main lessons of the study are that the legal framework needs to be improved in order to facilitate the exercise of building rights. The master's work consists of three chapters. The work uses legislation, the knowledge of law scientists, publications on the subject, as well as judgments of the court.
