Disciplināratbildība un tās piemērošana nacionālajos bruņotajos spēkos

Abstract

Bakalaura darba “ Disciplināratbildība un tās piemērošana nacionālajos bruņotajos spēkos” izstrādes pamatā tika likta ne vien militārpersonu īpašais status, bet arī disciplīnas nodrošināšanas un disciplinārās atbildības attīstības, klasifikācijas un piemērošanas jautājumi. Faktiskais pieņēmums, kas vijas cauri visam darba ir sekojošs: „Bez disciplīnas nav armijas” Šīs tēzes dažādie aspekti vijas cauri šim bakalaura darbam. Ņemot vērā, ka viena gadsimta laikā Latvijas militārie reglamenti tiek izstrādāti sākumā pielietojot Krievijas un PSRS militāros reglamentus, disciplīnas un disciplināratbildības jautājumus saskaņojot ar partneriem, pamatā ASV un NATO standartiem, tika salīdzināti Latvijas, Krievijas un ASV militārās atbildības regulējums. Tātad, caur vēsturisko prizmu tiek parādīta disciplināratbildības tiesiskā regulējuma attīstība, ņemot vērā arī cilvēktiesību aktuālos jautājumus un jaunākās likumdošanas iniciatīvas šajā jautājumā. Darbā ir ievads, viena paplašināta nodaļa ar 4 apakšnodaļām, divas nepaplašinātas nodaļas un secinājumi ar priekšlikumiem. Pirmajā nodaļā akcentēta disciplīna, tās jēdziens, disciplināratbildība un militārās disciplīnas attīstība Latvijā. Otrajā nodaļā autors analizē disciplinārlietu izmeklēšanas normatīvo regulējumu, izvērtē disciplināratbildības tiesiskos aspektus un aktualizē administratīvā procesa principu jēgu un būtību pareizākai piemērošanai, kā arī akcentē problemātiskos jautājumus karavīru militārajā disciplīnā un ar to saistītajās disciplinārlietās, kas skar disciplinārlietu procesuālo dabu. Trešajā nodaļās tiek salīdzināti Latvijas un ārzemju militārie reglamenti militārpersonu militārās disciplīnas nodrošināšanā izdarīti secinājumi. Autoram ir izdevies izpildīt savā darbā izvirzītos uzdevumus un atainot paveikto šajā bakalaura darbā un tā secinājumos.The development of the bachelor's thesis “Disciplinary Liability and its Application in the National Armed Forces” was based not only on the special status of military personnel, but also on the issues of ensuring discipline and the development, classification and application of disciplinary responsibility. The factual assumption that runs through all the work is this: "There is no army without discipline". The various aspects of this thesis run through this bachelor's thesis. Considering that during one century Latvia's military regulations are developed initially by applying the military regulations of Russia and the USSR, coordinating disciplinary and disciplinary liability issues with partners, mainly US and NATO standards, Latvian, Russian and US military liability regulations were compared. Thus, through the historical prism, the development of the legal regulation of disciplinary liability is shown, considering also the current issues of human rights and the latest legislative initiatives in this matter. The work has an introduction, one extended chapter with 4 subsections, two unexpanded chapters and conclusions with proposals. The first chapter emphasizes discipline, its concept, disciplinary responsibility and the development of military discipline in Latvia. In the second chapter the author analyzes the normative regulation of disciplinary investigation, evaluates the legal aspects of disciplinary liability and actualizes the meaning and essence of the administrative process principles for more correct application, as well as emphasizes problematic issues in military discipline and related military disciplinary matters. The third chapter compares Latvian and foreign military regulations and draws conclusions on the provision of military discipline to military personnel. The author has succeeded in fulfilling the tasks set in his work and showing the work done in this bachelor's thesis and its conclusions.
