Abstract
Bakalaura darba tēmā “Notariālā akta forma darījumos ar nekustamo īpašumu” veltīta, lai ar tiesību aktu, judikatūras un tiesību doktrīnas analīzi un interpretāciju, izvērsti atklātu notariālā akta kā tiesību sargājošā līdzekļa iespējas nekustamā īpašuma, īpaši, pirkuma darījumos – darījumos, kuru pamatā ir valsts svarīgākais resurss – zeme, izpētot un analizējot esošo problemātiku un pretrunas, uz izsakot priekšlikums tiesiskā regulējuma pilnveidošanai. Pētnieciskā darba gaitā ir identificētas problēmas, kas skar publiskās ticamības nodrošināšanas iespējas nekustamo īpašumu jomā, kura pamatā ir darījumu dalībnieku patstāvīgā dokumentu iesniegšana zemesgrāmatās un tā iespējamās sekas. Kā arī nelīdzvērtīgā personu un valsts interešu aizstāvība pirkuma darījumos. Darba gaitā atklāta problemātika, kas skar noziedzīgi iegūtu līdzekļu legalizāciju un izvairīšanos no nodokļu nomaksas nekustamo īpašumu darījumu jomā, atklājot procesuāli likumīgus apstākļus, pie kuriem darījuma dalībniekiem netiek veikta personu un naudas līdzekļu izcelsmes izpēte.
Lai spētu rasts objektīvus priekšlikumus tiesiskā regulējuma pilnveidošanai, darba pēdējā nodaļā izpētīta citu valstu prakse un notariālā akta pielietojuma apjoms Eiropas Savienības valstīs.
Bakalaura darbu sastāv no 57 lpp., kurās ietilps četras nodaļas, kuras ir sadalītas vairākās apakšnodaļās, nobeiguma daļa, kura ietverti secinājumi un priekšlikumi tiesiskā regulējuma pilnveidošanai un darbā izmantoto literatūras un avotu saraksts. Bakalaura darbs strukturēts, lai loģiski un secīgi atklātu notariālā akta būtību, pastāvošo problemātiku nekustamā īpašuma pirkuma darījumos un notariālā akta prevencijas iespējas atklātās problemātikas risināšanā.
The topic of the Bachelor thesis “The form of notarial act in real estate transactions” focuses on the discovery through the analysis and interpretation of legal acts, case law and legal doctrine of the possibilities of an open notarial instrument as a means of legal remedy in real estate transactions, especially in purchase transactions based on the most important resource of the state - land, by examining and analyzing the existing problems and contradictions, to make a proposal for the legal regulation improvement. In the course of the research work, problems have been identified that affect the possibilities of ensuring public credibility in the field of real estate, which is based on independent submission of documents by the transaction participants to the land registers and its possible consequences. As well as unequal protection of personal and state interests in purchase transactions. In the course of the work, problems related to the illegally obtained money laundering and tax evasion in the field of real estate transactions were discovered, revealing procedurally legal circumstances under which for the participants of the transaction, the origin of the persons and funds is not investigated. In order to be able to find objective proposals for the improvement of the legal regulation, the last chapter of the paper examines the practices of other countries and the extent of application of the notarial instrument in the countries of the European Union. The Bachelor thesis consists of 57 pages, which include four chapters, which are divided into several subchapters, the final part, which contains conclusions and proposals for the improvement of the legal regulation and a list of literature and sources used in the paper. The Bachelor thesis is structured in order to logically and sequentially reveal the essence of a notarial instrument, the existing problems in real estate purchase transactions and the possibilities of avoiding notarial instruments in addressing the issues exposed to general knowledge.
