Abstract
Maģistra darba tēma ir “Summētā darba laika organizācijas tiesiskie un praktiskie aspekti.”
Maģistra darba tēmas aktualitāte un juridiskie problēmjautājumi ir pamatojami ar to, ka darba laiks ir viens no svarīgākajiem nodarbinātības aspektiem. Neprecīzs tiesību normu regulējumu, kā arī atšķirīgā normu interpretācija vistiešākajā veidā var ietekmēt katra nodarbinātā darba samaksu. Darbs izklāstīts uz 85 lpp., izmantot 81 informatīvie materiāli.
Maģistra darba mērķis ir, pamatojoties uz summētā darba laika organizācijas normatīvā regulējuma analīzi, identificēt nozīmīgākās likuma normu problēmas, kā arī izaicinājumus to piemērošanai praksē, kā arī izstrādāt priekšlikumus darba likuma pilnveidošanai.
Darba mērķi autore sasniedza, pētot un salīdzinot starptautisko, Eiropas Savienības, Latvijas normatīvo regulējumu un analizējot tiesu praksi.
Darba izstrādes procesā autore nonāca pie secinājuma, ka Eiropas Savienības un Latvijas regulējumam vairākos aspektos nepieciešama pilnveidošana un stingrākas kārtības noteikšana, tāpat konkretizācija nepieciešama dažiem EST spriedumiem.
Maģistra darbā ir trīs nodaļas, kurās tiek izanalizēta summētā darba laika juridiskā pamatošana, un izteikti secinājumi un priekšlikumi pašreizējās likumdošanas uzlabošanā. Pirmajā nodaļā tiek apskatīta darba laika definīcija un veikta darba laika jēdziena analīze. Otrajā nodaļā tiek izpētīts summētā darba laika tiesiskais regulējums, jēdziens, būtība. Trešajā nodaļā tiek analizēta tiesu prakse, izteikti secinājumi un priekšlikumi darba likuma pilnveidošanai.
Subject of the master thesis is the “Legal and practical aspects of the organization of the aggregated working time”. The topicality and legal challenges of the master thesis are supported by the fact that working time is one of the most important aspects of employment. Inaccurate regulation within the legal framework, as well as divergent interpretation of legal norms can have direct impact on each employee’s remuneration. The master thesis consists of 85 pages, use 45 informative sources. The aim of the master's work is, on the basis of an analysis of the regulatory framework of the aggregated working time organization, to identify the major problems in the norms of the law, as well as challenges in applying them practically, as well as to develop recommendations for the improvement of the labor law. The author of the work reaches the goal by comparing the international, European Union, Latvian regulatory framework and by analyzing the case-law. In the process of developing the work, the author concluded that the regulation of the European Union and Latvia needs improvement and stricter regulation in a number of aspects, also certain European Union court judgments required further clarification. The Master's work consists of three chapters analyzing the legal basis of the aggregated working time and expressing conclusions and recommendations to improve the legislation. The first chapter deals with the definition of working time and analysis of the concept of working time. The second chapter examines the legal framework, concept, nature of the aggregated working time. The third chapter analyses the case-law, draws conclusions and proposals for the improvement of the labor law.
