Informācijas laikmetā, sabiedrībai attīstoties, katru dienu paplašinās to apdraudējumu loks, kas rada tiešu ietekmi uz cilvēka pamattiesībām, tostarp tiesībām uz privātās dzīves neaizskaramību un vārda brīvību. Tomēr, lai gan cilvēka pamattiesību augstākais uzdevums ir veidot sistēmu, kuras pamatā ir aizsardzība no šādu apdraudējumu ietekmes, nereti tieši pamattiesību starpā rodas zināma konkurence.
Autores ieskatā ir būtiski izvērtēt privātās dzīves neaizskaramības institūta un vārda brīvības savstarpējo mijiedarbību un robežu noteikšanas mehānismu, gadījumos, kad personas dati tiek apstrādāti žurnālistikas vajadzībām.
Saskaņā ar Vispārīgās datu aizsardzības regulas 85.pantu, Dalībvalstis ar tiesību aktiem saglabā līdzsvaru starp tiesībām uz personas datu aizsardzību saskaņā ar šo regulu un tiesībām uz vārda un informācijas brīvību, tostarp apstrādi žurnālistikas vajadzībām un akadēmiskās, mākslinieciskās vai literārās izpausmes vajadzībām.
Maģistra darbā autore vērš uzmanību uz personas datu aizsardzības un vārda brīvības tiesisko regulējumu žurnālistikas kontekstā, kā arī izvērtēs kā ar tiesību aktiem ir ieviests minēto pamattiesību līdzsvars Latvijas Republikā.
In the era of information, as society evolves, the range of threats that directly affect fundamental human rights, including the right to privacy and freedom of expression, is widening on a daily basis. However, while the ultimate task of fundamental human rights is to build a system based on protection from the effects of such threats, it is often precisely between fundamental rights that some competition arises. According to the author, it is essential to examine the interaction between the Institute for the Protection of private life and freedom of expression and the mechanism for delimitation where the personal data are processed for journalistic purposes. In accordance with Article 85 of the General Data Protection Regulation, Member States shall maintain, by law, a balance between the right to the protection of personal data under this Regulation and the right to freedom of expression and information, including processing for journalistic purposes and for the purposes of academic, artistic or literary expression. The author of the Master's theses draws attention to the legal framework of balance between the protection of personal data and freedom of expression in the context of journalism, as well as will assess how the balance between abovementioned fundamental rights has been implemented the Republic of Latvia.
