Kopsavilkums
Bakalaura darba tēma ir – Pagaidu aizsardzība pret vardarbību: Civilprocesuālais regulējums. Vardarbība pret personu ir būtiska sociāla problēma, kas ietekmē gan individuālo drošību, gan sabiedrības kopējo labklājību. Bakalaura darbā analizēts civilprocesuālais pagaidu aizsardzības mehānisms pret vardarbību Latvijā, īpašu uzmanību pievēršot tā tiesiskajam regulējumam, piemērošanas kārtībai un praksē pastāvošajām problēmām. Temata aktualitāti nosaka gan pieaugošais vardarbības gadījumu skaits, gan nepieciešamība nodrošināt efektīvu, savlaicīgu un cilvēktiesībās balstītu aizsardzību cietušajiem.
Darba ietvaros konstatēts, ka esošais regulējums nereti nav pietiekami efektīvs – palīdzība cietušajiem var tikt aizkavēta procesuālu un organizatorisku šķēršļu dēļ. Bakalaura darba mērķis bija izpētīt civilprocesuālo pagaidu aizsardzības mehānismu pret vardarbību, konstatēt problēmas, izdarīt secinājumus un sniegt priekšlikums tā uzlabošanai.
Darbs sastāv no 64 lappusēm.
Atslēgvārdi: pagaidu aizsardzība, vardarbība ģimenē, civilprocesuālais regulējums, cilvēktiesības, tiesu prakse.
The title of the bachelor's thesis is – Temporary Protection Against Violence: Civil Procedure Regulation. Violence against individuals is a significant social issue that affects both personal safety and the overall well-being of society. This bachelor's thesis analyzes the mechanism of temporary protection against violence within civil procedure in Latvia, with particular focus on the legal framework, its application procedure, and the practical challenges that arise. The relevance of the topic is determined by the increasing number of violence cases and the urgent need to ensure effective, timely, and human rights-based protection for victims. The study reveals that the current regulation is often not sufficiently effective – assistance to victims may be delayed due to procedural and organizational obstacles. The aim of the thesis was to examine the civil procedural mechanism for interim protection against violence, identify problems, draw conclusions, and propose improvements to the legal framework. The thesis consists of 64 pages. Keywords: temporary protection, domestic violence, civil procedure regulation, human rights, court practice.
