Valsts valodas likums: piemērošanas problemātika un risinājumi

Abstract

Maģistra darba "Valsts valodas likums: piemērošanas problemātika un risinājumi" mērķis ir izpētīt Valsts valodas likumā ietverto tiesisko regulējumu, izzinot ar tā piemērošanu saistītās problēmas, kā arī piedāvāt atbilstošus risinājumus, kas ne tikvien veidotu skaidrāku izpratni par likumā ietvertajām prasībām, bet arī risinātu pastāvošās juridiskās nepilnības. Pēdējo gadu laikā veikti vairāki grozījumi dažādu jomu normatīvajos aktos ar mērķi stiprināt latviešu valodas kā vienīgās valsts valodas pozīcijas un sekmēt integrāciju, kas pirmšķietami liecina par Valsts valodas likumā ietvertā tiesiskā regulējuma nepietiekamību šo mērķu sasniegšanai. Vienlaikus ir palielinājusies Latvijas iedzīvotāju vēlme aizsargāt savas tiesības ikdienā lietot valsts valodu. Maģistra darba ietvaros pētīti valsts valodas aizsardzības tiesiskie aspekti, Valsts valodas likuma ģenēze un tiesiskais ietvars, identificējot tā piemērošanas tvērumu un skaidrojot būtiskākos jēdzienus. Darba gaitā identificētas ar Valsts valodas likuma prasību piemērošanu saistītās problēmas, analizējot prasības dažādās likuma darbības jomās. Pētījuma rezultātā autors secina, ka valsts valoda ir būtisks nacionālās kultūras un identitātes elements, bez kura aizsardzības nodrošināšanas nav iedomājama valsts pastāvēšana. Valodas pastāvēšanas priekšnoteikums ir valodas lietotāju atbildība. Valsts valodas likumā ietvertais tiesiskais regulējums skar plašu jautājumu loku, tomēr izvirza tiešas prasības vien dažās darbības jomās, uz kurām attiecināmo prasību robežas nosakāmas pēc darbības sfēras – publiskās, privātās vai tās, kurā valsts neiejaucas, nodrošinot Latvijas Republikas Satversmē garantētās cilvēka pamattiesības. Maģistra darbs sastāv no trīs nodaļām un tā kopējais apjoms ir 94 lappuses.The purpose of the Master's thesis "Official Language Law: Problems of Application and Solutions" is to study the legal framework of the Official Language Law, to identify the problems associated with its application, as well as to propose appropriate solutions that would not only create a clearer understanding of the requirements contained in the law, but also address the existing legal deficiencies. In recent years, several amendments have been made to regulatory acts in various fields with the aim of strengthening the position of the Latvian language as the only official language and promoting integration, which apparently indicates the insufficiency of the legal framework contained in the Official Language Law to achieve these aims. At the same time, the desire of Latvian residents to protect their right to use the official language on a daily basis has increased. The Master's thesis examines the legal aspects of the protection of the official language, the genesis and legal framework of the Official Language Law, by identifying the scope of its application and explaining the key concepts. In the course of the work, the problems related to the application of the requirements of the Official Language Law were identified by analyzing the requirements in various areas of the law. The author concludes that the national language is an essential element of national culture and identity, without the protection of which the existence of the state is impossible. The existence of a language is conditioned by the responsibility of its users. The legal framework of the Official Language Law covers a wide range of issues, however, it imposes direct requirements in only a few areas of activity, the limits of which are determined by the sphere of activity – public, private or in which the state does not interfere, ensuring fundamental human rights guaranteed by the Constitution of the Republic of Latvia. The Master's thesis consists of three chapters and totals 94 pages.
