Privāto (maksas) autostāvvietu tiesiskais regulējums

Abstract

Pētījumā ir analizēta privāto (maksas) autostāvvietu tiesiskais regulējums Latvijas Republikā un ar to saistītā praktiskās piemērošanas problemātika, kopsakarā ar autostāvvietas pakalpojuma tirgū atšķirīgo darbības regulējumu privāto un valsts deleģēto komersantu vidū. Kopējais pētījuma apjoms ir 61 lappuses. Pētījuma mērķis ir noteikt problemātiku, kas ir saistīta ar tiesiskā regulējuma piemērošanu starp privāto komersantu un patērētāju civiltiesiskās attiecībās autostāvvietu pakalpojuma jomā. Pētījuma gaitā ir analizēti Latvijas Republikas normatīvie akti un nacionālā tiesu prakse, no kuras izriet, ka privāto autostāvvietu pakalpojuma tirgus dalībniekiem tiek piemērotas tādas prasības, kuras neattiecas uz valsts deleģētā identiskā pakalpojuma sniedzēju, radot nevienlīdzīgas konkurences apstākļus un nevienveidīgas prasības uz patērētāju tiesību aizsardzību. Pētījuma gaitā gūti secinājumi un izvirzīti ieteikumi, priekšlikumi likumdevējam, tiesiskā regulējuma pilnveidošanai un modernizācijai, veicinot vienveidīgas prakses īstenošanu.The research analyzes the legal regulation of private (paid) parking lots in the Republic of Latvia and the related problems of practical application, in connection with the different regulation of activities in the parking service market among private and state delegated companies. The total volume of the research is 61 pages. The aim of the research is to identify the problems related to the application of the legal framework between the private merchant and the consumer in civil law relations in the field of parking services. During the research, the regulatory enactments of the Republic of Latvia and national case law have been analyzed, from which it follows that private parking service market participants are subject to requirements that do not apply to the state delegated identical service provider, creating unequal conditions of competition and unequal requirements for consumer protection. During the research, conclusions have been obtained and recommendations have been put forward, proposals for the legislator, for the improvement and modernization of the legal framework, promoting the implementation of uniform practice.
