Kopsavilkums

Bakalaura darba tēma ir “Pašvaldības policijas kompetence sabiedriskās kārtības nodrošināšanā”, kurā tiek analizēta pašvaldības policijas loma, kā arī pašvaldības policijas kompetences robežas sabiedriskās kārtības nodrošināšanas jautājumos, pamatojoties Latvijas Republikas normatīvo regulējumu, kā arī uz starptautisko normatīvo aktu regulējumu. Darbā tiek aplūkoti tādi tiesību akti kā likums “Par policiju”, Apvienoto Nāciju Organizācijas 1948. gada 10. decembra Vispārējā cilvēktiesību deklarācija, Vispārīgā datu aizsardzības regula, Administratīvo sodu likums par pārkāpumiem pārvaldes, sabiedriskās kārtības un valsts valodas lietošanas jomā, kā arī pašvaldību saistošie noteikumi, proti, Rīgas domes 2007. gada 19. jūnija saistošie noteikumi Nr. 80 “Sabiedriskās kārtības noteikumi Rīgā” un Dobeles novada domes 2023. gada 26. janvāra saistošie noteikumi Nr. 5 “Dobeles novada sabiedriskās kārtības saistošie noteikumi”, kā arī tiek aplūkota citu valstu pieredze. Bakalaura darba mērķis ir izprast pašvaldības policijas funkcijas un analizēt normatīvo aktu piemērošanu praksē, lai pašvaldības policijas darbinieki spētu nodrošināt efektīvu sabiedriskās kārtības uzraudzību. Pētījumā tiek analizēti gan juridiskie, gan praktiskie izaicinājumi, kas saistīti ar pašvaldības policijas darbību, kā arī tiek sniegti ieteikumi normatīvā regulējuma pilnveidošanai. Bakalaura darbs sastāv no trīs nodaļām un apakšnodaļām: Pirmajā nodaļā tiek pētīta pašvaldības policijas vispārīgais raksturojums, iekļaujot vēsturisko aspektu, pašvaldības policijas uzdevumi un funkcijas, kā arī sabiedriskās kārtības jēdziens. Otrajā nodaļā tiek apskatīts normatīvo aktu regulējums attiecībā uz pašvaldības policijas kompetenci gan Latvijas Republikā, gan arī Eiropas Savienības dalībvalstīs. Trešajā nodaļā tiek analizēta normatīvo aktu piemērošana sabiedriskās kārtības nodrošināšanā pašvadības policijā, kā arī problemātika pašvaldības policijas praksē un tiek veikta analīze gan tiesu praksei, gan administratīvo pārkāpumu lietās. Bakalaura darbs sastāv no trīs nodaļām un trīs apakšnodaļām katrā. Darba apjoms ir 53 lappuses.
The theme of the barchelo’s thesis is “Competence of the municipal police in ensuring public order”, which analyses the role of the municipal police, as well as the limits of the competence of the municipal police in ensuring public order, based on the regulatory framework of the Republic of Latvia, as well as on the international regulatory framework. The work deals with such legal acts as the “Law on Police”, The United Nations Universal Declaration of Human Rights of 10 December 1948, The General Data Protection Regulation, the “Law on Administrative Penalties for Administrative Offences, Public order and Use of the State language”, as well as municipal binding regulations, namely the Rica City Council Binding Regulation No 80 of 19 June 2007 “Public Order Regulations in Riga” and of the Dobele District Council of 26 January 2023 No 5 “Public Order Regulations in Dobele District”, as well as the experience of the other countries are examined. The aim of the bachelor thesis is to understand the functions of the municipal police and to analyse the application of laws and regulations in practice in order to enable the municipal police to ensure effective supervision of public order. The study analyses both legal and practical challenges related to the functioning of the municipal police, as well as provides recommendations for improving the regulatory frammework. The bachelor thesis consists of three chapters and subchapters: The first chapter deals with the general charactristics of the municipal police, including the historical aspect, the tasks and functions of the municipal police, as well as the concept of public order. The second chapter deals with the legal and regulatory framework regarding the competence of the municipal police in the Republic of Latvia as well as in the Member States of the Eurpean Union. The third chapter analyses the application of normative acts in ensuring public order in self-government police, as well as the problems in the practice of municipal police and analyses both court practice and cases of administrative offences. The bachelor thesis cinsists of three chapters and three sub-chapters each. The thesis is 53 pages long.
