Kopsavilkums
Atrodoties alkohola, narkotisko, psihotropo, toksisko, citu apreibinošo vielu vai arī reakcijas ātrumu un uzmanību samazinošo medikamentu ietekmē, ir aizliegts vadīt vai mācīt vadīt transportlīdzekli. Tomēr, lai personai piemērotu atbildību – administratīvo vai kriminālatbildību –, ir svarīgi konkrētā pārkāpuma apstākļi, piemēram, reibumā vadītā transportlīdzekļa veids, transportlīdzekļa vadīšanas stāžs vai alkohola koncentrācijas līmenis asinīs. Administratīvo atbildību par vadīšanu vai mācīšanu vadīt transportlīdzekli alkohola reibumā vai narkotisko vai citu apreibinošo vielu ietekmē nosaka Ceļu satiksmes likums, paredzot transportlīdzekļa vadītājam naudas sodu un transportlīdzekļa vadīšanas tiesību atņemšanu. Tāpat, ja transportlīdzeklis vadīts apreibinošo vielu ietekmē, Krimināllikums paredz transportlīdzekļa konfiskāciju, bet, ja vadītājs pārkāpumu veicis ar transportlīdzekli, kas pieder citai personai, no personas, kura izdarījusi noziedzīgu nodarījumu, piedzen pilnu vai daļēju šī transportlīdzekļa vērtību.
Bakalaura darba mērķis: iepazīstoties ar transportlīdzekļa izņemšanas administratīvas atbildības ietvaros un transportlīdzekļa konfiskācijas kriminālatbildības ietvaros sakarā ar tā vadīšanu reibumā tiesiskiem un praktiskiem aspektiem, apzināt būtiskākos tiesiskās un praktiskā dabas problēmjautājumus un sniegt priekšlikumus to novēršanai, tādā veidā uzlabojot abus procesus, kas, iespējams, veicinātu izmaiņas vadīšanas reibumā paradumos.
Bakalaura darba galvenais uzdevums ir rast iespējas uzlabot transportlīdzekļa izņemšanas administratīvās atbildības ietvaros un tā konfiskācijas kriminālatbildības ietvaros sakarā ar tā vadīšanu reibumā tiesiskos un praktiskos problēmaspektus, lai padarītu šos procesus efektīvākus un atbilstošākus soda mērķim – atturēt personas no šādas rīcības nākotnē.
While under the influence of alcohol, narcotic, psychotropic, toxic, other intoxicating substances or reaction rates and attention-reducing medications, driving or teaching to drive is prohibited. However, for a person to be held liable, whether administrative or criminal, the circumstances of the offence in question are relevant, such as the type of vehicle driving under the influence, length of driving time or the level of blood alcohol concentration. Administrative liability for driving or teaching to drive under the influence of alcohol or narcotic or other intoxicating substances shall be determined by the Road traffic Law, providing for a fine for the driver of the vehicle and the deprivation of the right to drive. Similarly, if the vehicle is driven under the influence of intoxicating substances, the Criminal Law provides for the confiscation of the vehicle, but if the driver has committed the violation with a vehicle belonging to another person, the full or partial value of the vehicle shall be recovered from the person who has committed the criminal offence. Purpose of the Bachelor's work: by familiarising themselves with the legal and practical aspects of the removal of a vehicle within the scope of administrative responsibility and criminal liability for the confiscation of a vehicle due to driving under the influence, to identify the most significant issues of legal and practical nature and to make proposals to rectify them, thereby improving both processes, which would possibly contribute to changes in driving behaviour. The main task of the Bachelor's work is to find opportunities to improve the legal and practical aspects of the removal of a vehicle within the scope of administrative responsibility and its confiscation within the framework of criminal liability for driving it under the influence, in order to make these processes more efficient and consistent with the purpose of the punishment of deterring individuals from doing so in the future.
