Darba nosaukums: Fiziskās personas tiesības un pienākumi maksātnespējas procesā: tiesiskais regulējums un problemātika.
Bakalaura darba mērķis: Izanalizēt spēkā esošo civiltiesisko normatīvo regulējumu un tiesas praksi, izpētīt fiziskās personas parādnieka pienākumus un tiesības maksātnespējas procesā, lai identificētu iespējamās problēmas tiesiskajā regulējumā un piemērošanas praksē, izvirzītu priekšlikumus esošās problemātikas novēršanai.
Svarīgākie darba rezultāti:
1. Parādnieka pienākumi fiziskās personas maksātnespējas procesa ietvaros ir plaši un aptver dažādas jomas, kas aptver ne tikai sadarbību ar administratoru, bet arī esošās mantas atklāšanu, parādu atmaksu un ierobežojumus rīcībā ar savu personīgo mantu;
2. Maksātnespējas process šobrīd nesasniedz likumā noteikto mērķi;
3. Maksātnespējas process iedalās bankrota un saistību dzēšanas procedūras posmos, savukārt saistību dzēšanas procedūras posms iedala fizikās personas izmaksas tiešajos un netiešajos izdevumos.
4. Salīdzinot ar Baltijas valstīm, Lietuvā salīdzinoši nesen (visvēlāk) tika pieņemts maksātnespējas normatīvais regulējums- tikai 2023. gadā un šajā valstī ir mazākais fizisko personu uzsāktais maksātnespējas procesu skaits starp Baltijas valstīm (Latvijā ir vislielākais).
Bakalaura darba kopējais apjoms ir 70 lapaspuses, ieskaitot pielikumus. Bakalaura darbs satur 73 izmantotos literatūras avotus. Bakalaura darbs ir strukturēts četrās nodaļās.
Title of work: insolvency rights and obligations of the natural person: legal framework and issues. Purpose of the Bachelor's work: In analysing the existing civil legal framework and court practice, to examine the obligations and rights of the debtor of a natural person in insolvency proceedings in order to identify potential problems in the legal framework and application practice, to put forward proposals for rectification of the existing problem. Key work results: 1. The obligations of the debtor are broad and cover different areas, which include not only cooperation with the administrator but also disclosure of existing property, repayment of debts and restrictions on the handling of personal property; 2. The insolvency proceedings currently fail to achieve the statutory objective; 3. Insolvency proceedings are divided into stages of bankruptcy and redemption proceedings, while the stage of redemption proceedings is divided into direct and indirect costs of the physical person. 4. Compared to the Baltic States, Lithuania has relatively recently (most recently) adopted a regulatory framework for insolvency - only in 2023 and this country has the lowest number of insolvency proceedings initiated by natural persons between the Baltic States (Latvia has the highest number). The Bachelor's work totals 70 pages, including attachments. The Bachelor's work contains 73 sources of literature used. The Bachelor's work is structured across four chapters.
