Maģistra darbs “Nepilngadīgā cietušā nopratināšana kriminālprocesā un ar to saistītā problemātika” ir veltīts nepilngadīgā cietušā nopratināšanas kriminālprocesā izpētei.
Kopš Kriminālprocesa likuma spēkā stāšanās ir pagājuši jau 20 gadi. Šo gadu laikā vairākkārt ir tikuši veikti grozījumi attiecībā uz nepilngadīgo, t.sk. nepilngadīgo cietušo nopratināšanas īpatnībām kriminālprocesā.
Tā kā nepilngadīgā cietušā nopratināšanai kriminālprocesā ir sensitīvs raksturs, nepilngadīgā cietušā nopratināšanas procesam tiek pievērsta īpaša uzmanība. Ja nopratināšanas process netiek veikts ar pienācīgu uzmanību, kā arī, ja nopratināšanas procesu īsteno izmeklēšanas darbības veicējs, kurš nav ieguvis speciālās zināšanas darbā ar nepilngadīgajiem, vai, ja nopratināšanas procesā tiek piesaistīts psihologs bez atbilstošām zināšanām kriminālprocesā, kā arī psihologs, kurš nav ieguvis psihologa sertifikātu juridiskajā psiholoģijā, var radīt nepilngadīgajam cietušajam ilgstošas traumatiskas sekas. Vienlaikus jānorāda, ka šādās situācijās netiek ievērots bērna labāko interešu princips.
Ņemot vērā, ka nepilngadīgā cietušā nopratināšanas mērķis ir maksimāli aizsargāt bērna tiesības un emocionālo labklājību, ir būtiski, lai šo visvairāk neaizsargāto personu nopratināšana kriminālprocesā tiktu veikta piemērotā veidā, izmantojot atbilstošas pratināšanas metodes, tehnisko aprīkojumu, zināšanas un nepieciešamības gadījumā – speciālistu iesaisti.
Maģistra darbs sastāv no trīs nodaļām, kurās autore, aprakstot nepilngadīgā cietušā nopratināšanas kriminālprocesā tiesisko regulējumu, veic nepilngadīgā cietušā nopratināšanas kriminālprocesā tiesiskā regulējuma izpēti un analīzi, kā arī, izdarot secinājumus, izsaka savus priekšlikumus tiesiskā regulējuma pilnveidošanai.
Maģistra darba ietvaros autore sniedz atbildes uz izvirzītajiem pētījuma jautājumiem, izdara secinājumus un nobeigumā izsaka priekšlikumus tiesiskā regulējuma pilnveidošanai, veicot izmaiņas Kriminālprocesa likumā.

The master’s thesis “Interrogation of a Minor Victim in Criminal Proceedings and Related Issues” is dedicated to the examination of the interrogation process of a minor victim within criminal proceedings. Twenty years have passed since the Criminal Procedure Law came into force. During this time, multiple amendments have been made concerning minors, including the specific aspects of interrogating minor victims in criminal proceedings. As the interrogation of a minor victim in criminal proceedings is of a sensitive nature, special attention is paid to how this process is conducted. If the interrogation is not carried out with due care, or if it is conducted by an investigator who lacks specialized knowledge in working with minors, or if a psychologist without appropriate knowledge of criminal procedure or without a certification in legal psychology is involved, this can lead to long-term traumatic consequences for the minor victim. At the same time, it must be noted that such situations fail to observe the principle of the best interests of the child. Given that the purpose of interrogating a minor victim is to protect the child’s rights and emotional well-being to the fullest extent, it is essential that the interrogation of these particularly vulnerable individuals in criminal proceedings is conducted in an appropriate manner—using suitable interrogation methods, technical equipment, knowledge, and, when necessary, the involvement of qualified professionals. The master’s thesis consists of three chapters, in which the author, by outlining the legal framework governing the interrogation of minor victims in criminal proceedings, explores and analyzes the legal regulation of this process. Conclusions are drawn, and proposals are made for improving the existing legal framework. Within the scope of the master’s thesis, the author answers the posed research questions, draws conclusions, and in the final section offers proposals for improving the legal framework by suggesting amendments to the Criminal Procedure Law.
