Autora mērķis šī maģistra darba izstrādē ir veikt tiesību aktu, tiesu prakses un juridiskās literatūras izpēti, kas saistoša un piemērojama prasītājam civillietās par darījuma apstrīdēšanu. Autors vēlās atklāt svarīgus faktus, kas uzskatāmi ļauj identificēt civilprocesuālo problemātiku darījuma apstrīdēšanas institūta jomā, un uz iegūto informatīvo materiālu bāzes, tiks piedāvāti priekšlikumi attiecīgās jomas tiesiskā regulējuma pilnveidei.
Maģistra darbs sastāvēs no ievada, četrām galvenajām nodaļām, kur katrā ietilpstošas būs pāris, vai vairākas apakšnodaļas, nobeigums ar secinājumiem un priekšlikumiem, kā arī izmantotās literatūras un citu izpētes avotu saraksts.
Nodaļās klāstītā informācija secīgi izceļ izpētes objektus un aktualitātes, kas autora skatījumā skaidri akcentē problemātiku, kas saistīta ar darījuma apstrīdēšanas institūta civilprocesuālajiem aspektiem.
Maģistra darba ievadā tiek argumentēta un pamatota izvēlētā izpētes joma, norādot izpētes mērķi, izpētes objektu, darba priekšmetu, darba uzdevumus, kā arī pētnieciskās metodes.
Pirmajā nodaļā tiks izpētīta civillietās pieejamā darījuma apstrīdēšanas institūta būtība, un tā tiesiskais pamats Latvijas Republikā. Tiks izpētīts arī tas, kādi darījumi uzskatāmi par apstrīdamiem šī darījuma apstrīdēšanas institūta ietvarā.
Otrajā nodaļā izpētīts tiks apstrīdamo darījumu iedalījums, un to savstarpējā nošķiršana. Īpaši izcelti tiks civilajā apgrozībā nonākušie apstrīdamie fiktīvie un simulatīvie darījumi, tajā skaitā izzinot kādas ir attiecīgo darījumu biežākās formas.
Trešajā nodaļā autors pievērsīsies tādam svarīgiem darījuma apstrīdēšanas institūtā ietilpstošiem elementiem kā celtās prasības raksturs, un cieši saistīti ar to, celtajā prasībā rodamais prasības priekšmets. Attiecīgo elementu izpēte un izpratne par tiem tiks gūta pētot saistošos Latvijas Republikas tiesību aktus, un salīdzinoši, attiecīgo elementu regulējušos tiesību aktus arī citās Eiropas Savienības dalībvalstīs, īpašu uzsvaru liekot uz Igaunijas Republiku.
Ceturtajā nodaļā tiks atklātā patiesā un faktiskā civilprocesuālā problemātika, kas prasītājam šādās civillietās var būt saistoša, skarot tādus jomu kā valsts nodevu apmēri un to aprēķini, par noteiktu civilprocesuālu darbību veikšanu civillietās par darījuma apstrīdēšanu.
Authors aim in the development of this master's thesis is to conduct research of legal acts, court practice and legal literature, which is binding and applicable to the plaintiff in civil cases regarding deal contesting in civil cases. Author would like to reveal important facts that clearly allow to identify civil procedure issues in the field of the institute of deal contesting in civil cases, and on the basis of the obtained informative materials, proposals for improvement of the legal regulation in the respective field will be offered. The following masters thesis will consist of an introduction, four main chapters, each of which will contain a couple, or several subchapters, an ending part with conclusions, and suggestions for improvments of the related legislation. The information presented in the chapters successively highlights the objects of research and topical issues, which, in the author's view, would clearly highlight the problems related to the civil proceedings of the institute of contesting the transaction. In the introduction of this masters thesis, the chosen field of research is argued and substantiated, indicating the aim of the research, research object, subject of work, work tasks, as well as research methods. The first chapter will give an indepth view for the essence of the institute for deal contesting that is possible and usable in civil cases, with a closer overview regarding its legal basis in Republic of Latvia. It will also be examined which transactions are to be considered disputable within the framework of the institute of deal contesting. In second chapter, the research will be carried out by topics such as the division of disputed transactions, and their mutual separation. Particular emphasis will be placed on disputed fictitious and simulated transactions, including finding out what are the most common forms of disputed deals, that have already entered into real civil circulation. In third chapter, author will focus on such important elements of the institute of deal contesting as the nature of the action brought up in the court, and closely the related requirements of the action. The research and study of the relevant elements will be performed both by studying the binding legal acts of the Republic of Latvia, and in comparison, with relevant legal acts from other European Union member states that are applied to regulate institute of deal contesting. The fourth chapter will highlight the real and factual civil procedural issues that may be binding on the claimant in civil cases of deal contesting, specifically in such areas as fees for civil procedure applications that will or could be required in these civil cases.
