Darbs ir ikviena strādājoša indivīda būtiska dzīves sastāvdaļa, kas aizņem lielu daļu dzīves laika, tāpēc ir svarīgi nodrošināt optimālu balansu starp darba laiku un atpūtas laiku, dodot iespēju darbiniekam restartēties, tādejādi sekmējot darbinieka fizisko un garīgo spēju atjaunošanu un personisko vajadzību apmierināšanu, kas mūsdienu dinamiskajā darba vidē ir kļuvis par vienu no darba devēju un darbinieku izaicinājumiem.
Bakalaura darba mērķis ir, analizējot atpūtas laika tiesisko regulējumu darba tiesiskajās attiecībās, identificēt problēmas un sniegt iespējamos priekšlikumus Latvijas Republikas tiesiskā regulējuma pilnveidei.
Pētījuma rezultātā tika secināts, ka atsevišķos gadījumos attiecībā uz atpūtas laika piemērošanu tiesiskais regulējums Latvijas Republikā nav pietiekams, lai nodrošinātu, ka tiek ievēroti saistošo Eiropas Savienības tiesību aktu nosacījumi un judikatūras atziņas, piemēram, Latvijas Republikas Darba likumā nav noregulēti dežūras un izsaukuma gatavības nosacījumi, kas rada situācijas, kad atpūtas laika tiesiskais regulējums tiek interpretēts nekorekti, ko apliecina arī Latvijas Republikas judikatūra, kā arī nav noregulēti attālinātā darba un elastīga darba laika nosacījumi, tādejādi nenodrošinot mūsdienīgus risinājumus darba un atpūtas laika tiesiskā regulējuma kontekstā. Bez iepriekš minētā, tostarp ņemot vērā kaimiņvalstu – Igaunijas Republikas un Lietuvas Republikas, praksi, izdarīti arī citi secinājumi, kā arī sniegti priekšlikumi Latvijas Republikas tiesiskā regulējuma pilnveidošanai.

Work is an essential part of every working person's life and occupies a large part of their time, so it is important to ensure an optimal balance between working time and rest time, giving employees the opportunity to restart, thus contributing to the restoration of their physical and mental capacities and the satisfaction of their personal needs, which has become one of the challenges for employers and employees in today's dynamic working environment. The aim of the bachelor thesis is to analyse the legal regulation of rest time in employment relations, identify problems and provide possible proposals for improvement of the legal regulation of the Republic of Latvia. The study concluded that in some cases the legal framework in the Republic of Latvia regarding the application of rest periods is not sufficient to ensure that the provisions of binding European Union legislation and case law are complied with, for example, the Labour Law of the Republic of Latvia does not regulate on-call and stand-by conditions, which leads to situations where the legal regulation of rest time is interpreted incorrectly, as also confirmed by the case-law of the Republic of Latvia, as well as the conditions for remote working and flexible working time are not regulated, thus not providing modern solutions in the context of the legal regulation of working and rest time. In addition to the above, other conclusions are also drawn, including taking into account the practice of neighbouring countries - the Republic of Estonia and the Republic of Lithuania, and proposals are made for improving the legal framework of the Republic of Latvia. The volume of the work is 64 pages.
