Kopsavilkums
Bakalaura darba „Maznozīmīgu noziedzīgu nodarījumu dekriminalizācija” mērķis ir
analizēt maznozīmīgu noziedzīgu nodarījumu dekriminalizācijas iespējas Latvijas tiesiskajā
regulējumā, identificēt ar dekriminalizāciju saistītās problēmas un izstrādāt priekšlikumus.
Pētījuma rezultāti ļauj secināt, ka Latvijas tiesiskais regulējums un sodu politika
pakāpeniski pielāgojas starptautisko cilvēktiesību prasībām un citu Eiropas valstu tiesībām.
Latvijas tiesībām nav raksturīgs noziedzīgo nodarījumu dekriminalizācijas process, tiesiskā
regulējuma izmaiņas vairāk vērstas procesa vienkāršošanas un sodu humanizācijas virzienā.
Darba gaitā autore, balstoties uz tiesību speciālistu viedokļiem un citu valstu pieredzi,
izvērtē atsevišķu noziedzīgo nodarījumu dekrminalizācijas iespējas. Autore secina, ka tādi
noziedzīgie nodarījumi kā maza apmēra zādzības, krāpšanas un piesavināšanās ir
dekriminalizējami, tādējādi daļēji atslogojot penitenciāro sistēmu. Savukārt par neatļauto
narkotiku iegādāšanos, glabāšanu nelielā apmērā un lietošanu soda sankcija ir samazināma, no
soda sankcijas izslēdzot brīvības atņemšanas sodu un naudas sodu.
Darbs sastāv no ievada, izklāsta daļas un nobeiguma ar secinājumiem, kā arī autores
izstrādātajiem priekšlikumiem tiesību aktu pilnveidošanai. Darbā ir 57 lappuses.
The aim of the bachelor's thesis „Decriminalization of Minor Criminal Offenses” is to analyze the possibilities of decriminalization of minor criminal offenses in the legal framework of Latvia, to identify the problems related to decriminalization and to develop proposals. The results of the study allow to conclude that Latvian legal framework and penal policy are gradually adapting to international human rights requirements and the laws of other European countries. Latvian law is not characterized by the process of decriminalization of criminal offenses; the changes in the legal framework are more focused in the direction of simplifying the process and humanizing punishments. In the course of the research, the author, based on the opinions of legal specialists and the experience of other countries, evaluates the possibilities of decriminalization of certain criminal offenses. The author concludes that criminal offenses such as petty theft, fraud and embezzlement can be decriminalized, thus partially relieving the burden on the penitentiary system. On the other hand, for the purchase, possession and use of illegal drugs, the penalty can be reduced by excluding the penalty of deprivation of liberty and a fine. The work consists of an introduction, the analytical and empirical part, and a conclusion with conclusions and proposals developed by the author for the improvement of legal acts. The study comprises 57 pages.
