Bakalaura darba mērķis: pētīt preču zīmes un dizainparauga krimināltiesiskās aizsardzības ieviešanu, piemērošanu un problemātiku Latvijā.
Tēma ir aktuāla gan teorētiski, gan praktiski, ņemot vērā nepieciešamību veicināt Latvijas tiesiskās sistēmas efektivitāti un pielāgošanos starptautiskajiem standartiem. Detalizēta problēmu analīze un risinājumu izstrāde sniedz ieguldījumu ne tikai tiesiskās aizsardzības mehānismu uzlabošanā, bet arī Latvijas konkurētspējas un drošības stiprināšanā globālajā ekonomikā.
Darba apjoms ir 50.lpp. Darbā izmantoti literatūras un informācijas avoti, tiesu prakse. Darbā autors izmantos induktīvo, analītiski pētniecisko, vēsturisko pētījuma, gramatisko un loģiski konstruktīvo pētījuma metodi, lai veiktu tēmas jautājumu vispusīgu analīzi un izdarīt ar to saistītus secinājumus.
Darbs sastāv no trīs nodaļām. Pirmajā nodaļā tiks aplūkots gan vēsturiskais, gan mūsdienu preču zīmju un dizainparaugu aizsardzības normatīvais regulējums Latvijā, kā arī kāda ietekme ir Eiropas Savienības likumdošanai uz Latvijas likumdošanu attiecīgajā jomā. Otrajā nodaļā tiek aplūkota preču zīmes un dizainparauga aizsardzības piemērošanas kārtība. Trešajā nodaļā tiek analizēta problemātika preču zīmes un dizainparauga aizsardzībā Latvijas Republikā.
Izstrādājot darbu, autors identificēja problēmas, kuras saskatāmas tiesu praksē, proti, izaicinājumi, kas saistīti ar tiesībsargājošo institūciju kapacitāti un pieredzi sarežģītu intelektuālā īpašuma pārkāpumu lietu risināšanā, kā arī, viena no būtiskākajām problēmām ir zaudējuma apmēra konstatēšana un subjektīvās, objektīvās puses pierādīšana.
Preču zīmju un dizainparaugu aizsardzība Latvijā darbojas pietiekami, taču lai tā darbotos nevainojami ir jāveido cieša sadarbība ar intelektuālā īpašuma īpašniekiem, kā arī jāveic grozījumi Krimināllikuma 206.pantā, lai noziedzīgs nodarījums būtu skaidri identificējams un subjektīvās, objektīvās puses pierādīšana nebūtu šķērslis piemērot kriminālatbildību.
The title of the Bachelor's work: “Criminal protection of the trade mark and design in Latvia: implementation, application and problem”. Subject of Bachelor's work: criminal relations arising in the event of trademark infringement. Subject-matter of the Bachelor's work: regulatory framework, which related to the protection of trademarks and designs in Latvia. Purpose of the Bachelor's work: to study the introduction, application and problem of criminal legal protection of a trade mark and design in Latvia. The topic is current both in theory and in practice, taking into account the need to promote the efficiency of the Latvian legal system and adaptation to international standards. Detailed analysis of problems and development of solutions can contribute not only to improving legal protection mechanisms, but also to strengthening Latvia's competitiveness and security in the global economy. The amount of work is on page 50. The work uses sources of literature and information, case law. In the work, the author will use the inductive, analytically investigative, historical study, grammatical, and logically constructive study method to conduct a comprehensive analysis of subject matters and draw related conclusions. The work consists of three chapters. The first chapter will look at both the historical and contemporary legal framework for the protection of trademarks and designs in Latvia, as well as the impact of European Union legislation on Latvian legislation in the relevant field. The second chapter deals with the application of the protection of the trade mark and the design. Chapter three will analyse the issue of protection of the trade mark and design in the Republic of Latvia. When drafting the work, the author identified the problems that can be seen in case law, namely the challenges related to the capacity and experience of law enforcement authorities in solving complex intellectual property infringement cases, as well as one of the most significant problems is finding the extent of the loss and demonstrating the subjective, objective side. The protection of trade marks and designs in Latvia is sufficient, but it is necessary to establish close co-operation with intellectual property owners and to amend Section 206 of the Criminal Law so that the criminal offence is clearly identifiable and the demonstration of the subjective, objective side does not constitute an obstacle to the application of criminal liability.
