Rezidentūras finansēšanas kārtība: problemātika un iespējamie risinājumi

Abstract

Maģistra darbā tiek analizēta medicīnas rezidentūras finansēšanas kārtība un tās ietekme uz pamattiesībām. Lai arī medicīnas rezidentūras jautājums Latvijā pēdējo gadu laikā ir kļuvis daudz aktuālāks un biežāk apspriests, ir joprojām redzamas situācijas, kurās tiek aizskartas gan pašu rezidentu un jauno ārstu pamattiesības, gan dažās situācijās tas ietekmē pat visu sabiedrību kopumā. Rezidentūras finansēšanas kārtība ir salīdzinoši novecojusi un nav pielāgota mūsdienu straujajai dzīves un mdicīnas attīstībai, kā arī vieglprātīgā pieeja medicīnas nozares uzraudzībā, rezultējās dažādos pamattiesību aizskārumos. Tādēļ šī maģistra darba izstrāde ir saistīta ne tikai ar normatīvajos tiesību aktos ietvertā tiesiskā regulējuma un tiesu prakses analīzi, bet arī ar vēsturiskās attīstības un prakses salīdzināšanu.

Maģistra darbā tiek pētīta medicīnas rezidentūras finansēšanas kārtība pamattiesību perspektīvā Latvijā, Eiropā un Amerikas Savienotajās valstīs, kā arī tiek noskaidrots “pamattiesības rezidentūras finasēšanā” tvērums pastāvošās juridiskās interpretācijas ceļā. Pētījuma ietvaros tiek atklāti kritēriji, uz kuru pamata iespējams konstatēt pamattiesību pārkāpumu rezidentūras finansēšanas un atstrādes noteikumu jautājumos, pastāvošās sistēmas ietekmi uz pamattiesību ievērošanu nepietiekamība. Darba ietvaros autors sniedz praktiskus risinājumus gan pamattiesību aizsardzības veicināšanai, gan rezidentūras finansēšanas sistēmas sakārtošanai.

Ņemot vērā medicīnas rezidentu un jauno ārstu, kā arī veselības sistēmas attīstību šis maģistra darbs ir potenciāls ieguldījums gan sabiedrības izpratnes veicināšanā pamattiesību un medicīnas tiesību jomā, gan papildu pētījums, kas padziļina tiesību jomā strādājošo profesionāļu izpratni par tiesību uz profesijas izvēli, veselības aprūpi un tiesību uz izglītību saistību ar medicīnas tiesību normām.The master's thesis analyzes the procedure for financing medical residency and its impact on fundamental rights. Although the issue of medical residency has become much more relevant and discussed more often in Latvia in recent years, there are still situations when the basic rights of residents and young doctors are violated, and in some situations it even affects the entire society as a whole. . The procedure for funding the residency is relatively outdated and not adapted to today's rapid development of life and medicine, as well as the light-hearted approach to the supervision of the medical industry, caused various violations of fundamental rights. Therefore, the development of this master's thesis is related not only to the analysis of the legal framework and court practice included in the normative legal acts, but also to the comparison of historical development and practice. The master's thesis examines the procedure for financing medical residency from the point of view of fundamental rights in Latvia, Europe and the USA, and with the help of the existing legal interpretation, the extent of "fundamental rights in financing residency" is clarified. Within the framework of the research, the criteria are revealed, on the basis of which it is possible to establish the violation of fundamental rights in the issues of residency financing and development regulation, the insufficiency of the existing system's influence on compliance with residency financing and development regulations. fundamental rights. Within the framework of the work, the author provides practical solutions both for promoting the protection of fundamental rights and for arranging the residency financing system. Taking into account the development of medical residents and young doctors, as well as the health system, this master's thesis is a potential contribution to public awareness in the field of fundamental rights and medical law, as well as additional research that deepens the understanding of legal professionals about the right to the profession, health care and law on the relationship between education and medical law.
