Abstract
Bērna tiesības uz uzturlīdzekļiem un vecāku pienākums bērnam tos sniegt ir nostiprināti gan nacionālajos, gan starptautiskajos normatīvajos aktos. Taču ir gadījumi, kad viens vai abi vecāki nepilda normatīvajos aktos nostiprināto pienākumu - nodrošināt bērnu ar uzturlīdzekļiem. Tāpēc valsts ir izveidojusi Uzturlīdzekļu garantiju fondu, lai aizsargātu bērna tiesības un sniegtu viņam sociālo nodrošinājumu tā vecāka vietā, kurš savu pienākumu nepilda.
Valsts no valsts budžeta ietvara jeb Uzturlīdzekļu garantiju fonda mēnesī vidēji izmaksā aptuveni 4 miljonus euro, taču no uzturlīdzekļu parādniekiem spēj atgūt ne vairāk kā 1 miljonu euro. Lai regresa kārtībā atgūtu lielāku uzturlīdzekļu apmēru, ir ieviesti vairāki tiesību ierobežojumi uzturlīdzekļu parādniekiem. Tādējādi maģistra darba “Uzturlīdzekļu parādnieku ierobežojumu tiesiskais regulējums un regresa kārtībā atgūto uzturlīdzekļu apmēra palielināšana” mērķis ir izpētīt tiesiskā regulējuma problēmas uzturlīdzekļu parādnieku ierobežojumiem regresa kārtībā atgūto uzturlīdzekļu apmēra palielināšanai un izstrādāt priekšlikumus normatīvo aktu pilnveidošanai, lai nodrošinātu lielāku uzturlīdzekļu parāda atgūšanu regresa kārtībā no uzturlīdzekļu parādniekiem.
Darbā tika secināts, ka astoņi tiesību ierobežojumi, kas ieviesti uzturlīdzekļu parādniekiem, nesekmē pilnīgu regresa kārtībā atgūto uzturlīdzekļu apmēru iepretim izmaksātajam uzturlīdzekļu apmēram, tāpēc darba ietvaros sniegti vairāki priekšlikumi, kas sekmētu lielāku regresa kārtībā atgūto uzturlīdzekļu apmēru un novērstu uzturlīdzekļu parādnieka darbošanos “nelegālā” darba tirgū - bezdarbnieka statusa obligāta iegūšana, regulāra lēmuma pārskatīšana situācijās, kad tiek pieņemts lēmums par uzturlīdzekļu parādnieka transportlīdzekļu vadīšanas tiesību liegumu vai šaujamieroču darbības apturēšanas nepiemērošanu, kā arī bāriņtiesu funkciju pilnveidošana utt.

The rights of the child to maintenance and the duty of parents to ensure it for the child have been enshrined both in national and international legal acts. However, there are cases when one or both of the parents fail to fulfil the duty imposed by legal acts – to ensure the child with maintenance. For this reason, the State has established the Maintenance Guarantee Fund to protect the rights of the child and to provide social security to them in place of the parent who fails to fulfil his or her duty. The average monthly amount of euros disbursed by the State from the State budget framework or the Maintenance Guarantee Fund is 4 million euros; however, not more than 1 million euros can be recovered from maintenance debtors. In order to recover greater amount of maintenance by way of subrogation, several restrictions on rights have been introduced in respect of maintenance debtors. Therefore, the objective of the master’s thesis “Legal Framework for Restrictions on Maintenance Debtors and the Increase in the Amount of Maintenance Recovered by Way of Subrogation” is to study the challenges of legal framework in respect of restrictions on maintenance debtors for increasing the amount of maintenance recovered by way of subrogation and to develop proposals for the improvement of laws and regulations in order to ensure greater recovery of maintenance debt from maintenance debtors by way of subrogation. The thesis has resulted in conclusions that eight restrictions on maintenance debtors introduced do not facilitate full recovery of maintenance by way of subrogation in comparison with the amount of maintenance disbursed; therefore, the thesis offers several proposals that would facilitate greater recovery of maintenance debt by way of subrogation and would prevent the maintenance debtor from operating in the “illegal” labour market – mandatory obtainment of the status of an unemployed person, review of the decision on a regular basis when a decision is taken to not apply the prohibition to use a driving licence or suspension of the operation of the firearm permit, and also the development of the functions of the Orphan’s and Custody Courts, etc. The total number of pages of the thesis – 94.
