Kopsavilkums
Bakalaura darba tēma „Aizturētā statuss kriminālprocesā” ir aktuāla tēma Latvijas Republikā. Mūsdienās, kad daudzi starptautiskie, kā arī Latvijas Republikas normatīvie akti reglamentē cilvēka tiesības, un nosaka to ierobežošanas gadījumus, īsteno personas tiesību aizsardzību, aktuāls kļūst jautājums par personas aizturēšanu kriminālprocesā.
Darba mērķis ir mērķis ir izpētīt aizturētā statusa reglamentācijas problēmas KPL, lai konstatētu problēmjautājumus, kā arī sniegt priekšlikumus to risinājumam.
Bakalaura darba izstrādes laikā tiks analizēti prakses materiāli, kā arī tiks analizētas KPL 63.pantā reglamentētās aizturēto personu tiesības, tiks salīdzināts KPL reglamentētais aizturētās personas statuss ar Krievijas Federācijas, Vācijas un Kazahstānas KPK reglamentēto aizturētās personas statusu, kā arī tiks aplūkoti vairāku autoru viedokļi par aizturēšanas nosacījumu pārkāpumiem.
Nobeigumā ir autores izdarītie secinājumu par aizturēto personu tiesību aizskārumiem, aizturēšanas nosacījumu neievērošanu un ar to saistītām problēmām, kā arī bakalaura darba autores piedāvātie priekšlikumi par darba tēmu.
Darba apjoms ir 56 lapas.
The topic of tje bachelors thesis “Status of detainee in criminal proceedings” is currently important and revelant for the Republic of Latvia. Nowadays international and national laws regulate human rights, determine the cases of the limitation and restriction, and implement the protection of individual rights. Therefore the detention of a suspected or accused person in criminal proceedings becomes a topical subject which is hugely important at the moment. The thesis aims to research the issues of the regulation of the detained person status in the Criminal Procedure law, in order to identify major challenges and gaps, as well as to propose potential solutions. In this dissertation detained person rights regulated and stated in article 63 of the Criminal Procedure law were analyzed, the detained person status regulated in the Criminal Procedure law was compared with the definitions provided by the legislation of the Russian Federation, Germany, and Kazakhstan, and complemented by varios industry expert opinions on the violation of detained person rights. Finnlay, the author concludes on the violations of the rights of detainees, non-compliance with the conditions of detention and related problems and proposes further research directions.
