Temata aktualitāte: Bērnu pornogrāfijas izplatība pēdējos gados ir sasniegusi bezprecedenta apmērus, un, kaut arī ne visos gadījumos, tomēr galvenokārt tās izplatība norisinās elektroniskā vidē. Vērojama tendence palielināties tieši nepilngadīgu personu izdarītiem nodarījumiem elektroniskajā vidē. Ar bērnu pornogrāfijas apriti saistīti jēdzieni un tiesiskais regulējums noteikts gan nacionālos, gan starptautiskos tiesību aktos, tomēr praksē reizēm problēmas rada gan sabiedrības, gan kompetentu iestāžu atšķirīga ar to saistītu tiesību normu izpratne un interpretācija. Minētā rezultātā praksē konstatējamas nepilnības konkrētu tiesību normu, kas attiecināmas uz bērnu pornogrāfijas apriti, izpratnē un piemērošanā, savukārt tas negatīvi ietekmē efektīvu Krimināllikuma normu piemērošanu un krimināltiesisko attiecību taisnīgu noregulējumu. Pētījuma mērķis: izpētot bērnu pornogrāfijas aprites krimināltiesiskos aspektus un izzinot tiesiskā regulējuma problēmas, izstrādāt ieteikumus bērnu pornogrāfijas aprites tiesiskā regulējuma pilnveidei un esošo normu vienveidīgai izpratnei. Pētījuma priekšmets: tiesiskais regulējums, kas saistīts ar bērnu pornogrāfijas apriti. Pētījuma objekts: tiesiskās attiecības, kas saistītas ar bērnu pornogrāfijas apriti. Pētījumā iegūtie rezultāti: Noskaidrotas atbildes uz pētījuma jautājumiem, izpildot maģistra darba mērķa sasniegšanai noteiktos uzdevumus. Izzināti un izprasti bērnu pornogrāfijas aprites krimināltiesiskie aspekti, kas būtiski atbilstošu tiesību normu piemērošanā un minētā nozieguma kvalificēšanā, nolūkā panākt taisnīgu tiesisko regulējumu. Izdarīti secinājumi un izteikti priekšlikumi, tai izstrādāti ieteikumi tiesiskā regulējuma pilnveidei. The trend is towards an increase in offences committed by minors in the electronic environment. The concepts and legal framework relating to the circulation of child pornography are laid down in both national and international legislation, but in practice problems are sometimes caused by divergent understandings and interpretations of related legal provisions by both the public and the competent authorities. As a result, in practice, gaps in the understanding and application of specific legal provisions relating to the circulation of child pornography are found, which in turn has a negative impact on the effective application of the provisions of the Criminal Law and the fair regulation of criminal law relations. Aim of the research by examining the criminal aspects of the circulation of child pornography and identifying the problems of the legal framework, to develop recommendations for improving the legal framework for the circulation of child pornography and for a uniform understanding of the existing norms. Research subject: legal framework related to the circulation of child pornography. Research object: legal relations related to the circulation of child pornography. Results of the research: answers to the research questions have been found, fulfilling the objectives of the Master's thesis. The criminal aspects of the circulation of child pornography have been identified and understood, which are essential for the application of appropriate legal norms and the qualification of this crime, with a view to achieving a fair legal framework. Conclusions and proposals are drawn and recommendations are made for improving the legal framework.
