Abstract
Maģistra darba tēma: Pārvaldes uzdevumu deleģēšanas tiesiskais regulējums un problemātika pašvaldībās.
Darba autors:
Pieredze un prakse liecina, ka pamatos un kopumā situācija valsts pārvaldes uzdevumu deleģēšanā vēl aizvien nav apmierinoša. Iemesli tam ir vairāki, var teikt - sistēmiski, proti, darbības ir fragmentāras un kampaņveida, netiek veikta regulāra valsts pārvaldes uzdevumu deleģēšanas uzraudzība, kā arī vērojama nepietiekama situācijas pārvaldes uzdevumu deleģēšanā analīze un nākotnes prognozes.
Lai gan valsts un pašvaldību savstarpējās sadarbības uzlabošanā ir vērojams progress, tas vēl aizvien ir raksturojams kā lēns un lielā mērā atkarīgs no izskatāmā jautājuma būtības. Valsts pārvaldes iestādēm un pašvaldībām bieži vien ir pretēji viedokļi par pašvaldības un valsts funkcijām, kā arī finanšu plānošanu pašvaldību līmenī.
Novadu pašvaldību sistēma iedzīvotāju skaita ziņā ir ļoti neviendabīga, tas apgrūtina tālāko publiskās pārvaldes pilnveides procesu.
Darbā izvirzīts un sasniegts mērķis: iegūt analītisku informāciju, izdarīt secinājumus un izteikt priekšlikumus, kurus īstenojot varētu uzlaboties Latvijas valsts pārvaldes iestāžu darbs, deleģējot atsevišķus valsts pārvaldes uzdevumus pašvaldībām, kā arī privātpersonām, kas savukārt ļautu ekonomēt cilvēku un finansiālos resursus.
Tomēr pastāv problēmas iepazīties ar deleģēšanas līgumiem, jo atsevišķu pašvaldību mājas lapās tie nav atrodami.
Darba izstrādes gaitā tika pētīts:
Pārvaldes jēdziens, būtība un kvalitātes vadības principi.
Pārvaldes uzdevumu būtība, vadības principi un juridiskais pamats pašvaldībās.
Deleģēšanas jēdziens likumdošanā.
Valsts pārvaldes uzdevumu nodošanas process, juridiskais pamats, tipi:
Deleģējums citai publiskai personai.
Deleģējums privātpersonai.
Pilnvarojums privātpersonai.
Deleģēšanas līgums kā viens no efektīvākajiem valsts pārvaldes uzdevumu nodošanas procesiem.
Darba gaitā tika izvirzīti vairāki pētnieciskie mērķi, lai noskaidrotu,
- kāpēc Valsts pārvaldes uzdevumu deleģēšanas prakse vēl arvien nav pietiekami attīstīta, nav precīzi noteikti principi un kārtība, lai izvērtētu, vai privātpersona var veikt attiecīgo uzdevumu efektīvāk, kā arī nav noteikta izvērstāka funkciju un uzdevumu deleģēšanas procedūra. Nepastāv vienota administratīvo izdevumu aprēķināšanas sistēma un metodika, kas liedz veikt objektīvu paredzamo darbību izmaksu aprēķinu.
- kāpēc praksē netiek konstatēta pietiekama kontrole pār to, vai uzdevuma nodošana turpina būt efektīvāka arī vēlāk, kad uzdevumu jau uzsākusi pildīt tam pilnvarotā persona.
- gūta atziņa, analizējot pārvaldes uzdevumu nodošanas praksi Latvijā un uzdevumu nodošanas procesu, ka ideālā gadījumā tam būtu jāsastāv no četriem lieliem posmiem: Šie posmi ir Valsts pārvaldes uzdevumu:
- nodošanas plānošana,
- pretendentu atlase,
- nodotā uzdevuma izpilde
Subject: Legal framework for delegation of management tasks and issues in municipalities. Author of the work: Experience and practice have shown that the situation in the delegation of public administration tasks is still unsatisfactory on the basis and overall. There are a number of reasons for this, it can be said that systemically, i.e. activities are fragmented and campaign-based, there is no regular monitoring of the delegation of public administration tasks, as well as insufficient analysis and forecasts of the delegation of tasks of management of the situation. Although progress has been made in improving cooperation between state and local authorities, it remains to be described as slow and largely dependent on the nature of the issue under consideration. Public administrations and municipalities often have opposing views on local government and state functions, as well as financial planning at municipal level. The municipality system is very heterogeneous in terms of population, which makes it difficult to further develop public administration. The aim has been pursued and achieved: to obtain analytical information, to draw conclusions and to make proposals that could improve the work of Latvian state administration institutions by delegating certain tasks of state administration to local governments, as well as to individuals, which in turn would allow for the saving of human and financial resources. However, there are problems getting acquainted with delegation agreements because they cannot be found on the home pages of individual municipalities. In the course of the development of work, the following were examined The concept, nature and quality management principles of governance. Nature of management tasks, principles of management and legal basis in municipalities. The concept of delegation in legislation. Process of transfer of public administration tasks, legal basis, types: Delegation to another public person. Delegation to a private individual. Authorisation to a private individual. Delegation agreement as one of the most efficient processes for transferring tasks of public administration. In the course of the work, a number of research objectives were identified in order to clarify: - why the practice of delegating public administration tasks is still not sufficiently advanced, the principles and procedures have not been specified to assess whether the individual can perform the task more effectively, nor does it prescribe a more detailed procedure for delegating functions and tasks. There is no uniform system for calculating administrative expenditure and a methodology that prevents an objective calculation of the expected costs of operations. - why does not in practice establish sufficient control over whether the transfer of the task continues to be more effective even later, when the task has already been carried out by the authorised person.
