Maģistra darbs veltīts tēmai “Spiegošanas krimināltiesiskais regulējums un aktuālā problemātika”. Temata aktualitāte ir saistīta ar ģeopolitiskās spriedzes palielināšanos Eirāzijas kontinentā un vairāku konfliktu, tostarp militāro konfliktu, attīstību pasaulē, kas rada nepieciešamību iegūt nozīmīgu un apsteidzošu informāciju. Viens no veidiem, kā valstu interesēs tiek iegūta nepieciešamā informācija, ir slēptā veidā organizēta spiegošana. Latvijas Republikas Krimināllikumā ir noteikta atbildība par spiegošanu, kā arī spiegošanas organizēšanu un vadīšanu, taču spiegošanas krimināltiesiskais regulējums kopš Latvijas Republikas neatkarības atjaunošanas pirmo reizi tika piemērots vien 2016. gadā.
Darba mērķis ir, balstoties uz normatīvo aktu un dokumentu analīzi, kā arī tiesu praksi un citu valstu piemēriem, pētīt nacionālā regulējuma piemērošanas aspektus un ar regulējumu saistīto problemātiku, lai noskaidrotu iespējamos risinājumus regulējuma pilnveidei. Darbā secināts, ka problemātika saistāma ar ierobežotu Krimināllikuma regulējuma tvērumu attiecībā uz atsevišķām spiegošanas aktivitātēm, kas saistītas ar personas veiktu ziņu nodošanu pēc savas iniciatīvas, kā arī spiegošanas regulējums ietver darbības, kas neatbilst spiegošanas būtībai.

The Master's thesis is dedicated to the topic “Criminal Law Regulation of Espionage and Current Issues.” The relevance of the topic is linked to the increasing geopolitical tension on the Eurasian continent and the development of various conflicts, including military conflicts around the world, which creates the need to obtain significant and anticipatory information. One of the ways in which states acquire the necessary information in their interests is through covertly organized espionage. The Criminal Law of the Republic of Latvia provides for liability for espionage, as well as for organizing and directing espionage activities; however, the criminal law regulation of espionage was applied for the first time since the restoration of Latvia's independence only in 2016. The aim of the thesis is, based on the analysis of normative acts and documents, as well as case law and examples from other countries, to study aspects of the application of the national regulation and the related issues, in order to identify possible solutions for improving the regulation. The thesis concludes that the issues are related to the limited scope of the Criminal Law's regulation concerning certain espionage activities, particularly those involving individuals transmitting information on their own initiative, and that the espionage regulation includes actions that do not correspond to the true nature of espionage.
