Abstract
Darba tēma ir “Afekta stāvoklī izdarīta noziedzīga nodarījuma kvalifikācijas problēmas”. Darba pirmajā un otrajā daļā tiek izpētīts stipra psihiska uzbudinājuma stāvokļa raksturojums, noteikšanas etapi un pazīmes. Darba trešajā daļā tiek izpētītas Krimināllikuma 120. un 127. panta objektīvās un subjektīvās pazīmes. Darba ceturtajā daļā tiek izpētīts ārvalstu regulējums par slepkavību, kas izdarīta stipra psihiska uzbudinājuma stāvoklī. Noziedzīgs nodarījums, kas izdarīts afekta stāvoklī ir ar mīkstinošu apstākli, kas ļauj piemērot mīkstāku sodu. Lai kvalificētu noziedzīgu nodarījumu mīkstinošos apstākļos ir jāizpildās visiem afekta stāvokļa kritērijiem. Darba mērķis ir izpētīt Krimināllikuma 120. un 127. panta kvalifikācijas problēmas. Stiprs psihisks uzbudinājuma stāvoklis iedalās fizioloģiskajā afekta stāvoklī un patoloģiskajā stāvoklī. Lai noteiktu afekta stāvokļa esamību ir jāizpildās visiem nosacījumiem un tiesu medicīnas ekspertīzes laikā ir jānosaka afekta stāvokļa esamību noziedzīga nodarījuma laikā. Stipra psihiska uzbudinājuma stāvoklis ir paredzēts Krimināllikuma 120 un 127. pantā un kā obligāts nosacījums šiem sastāviem ir tas, ka cietusī persona ir veikusi vardarbīgas darbības vai smagu goda un cieņas aizskārumu pret vainīgo. Krimināllikuma 127. panta noziedzīga nodarījuma sastāvs ir ļoti līdzīgs Krimināllikuma 120. panta stastāvam. Ja noziedzīgs nodarījums afekta stāvoklī ir nodarīts ar Krimināllikuma 117. panta kvalificējamajiem apstākļiem, tad nodarījums ir jākvalificē pēc Krimināllikuma 127. panta. Salīdzinot Krimināllikuma 120. panta regulējumu ar ārvalstu kriminālkodeksu var secināt, ka ārvalstīs ir iekļauts plašāks darbību skaits un personu loks, kas var izraisīt stipru psihiska uzbudinājuma stāvokli. Darba kopējais apjoms ir 52 lappuses.
The bachelor thesis aims to examine qualification issues of the criminal offense, committed in the heat of passion. The first and second parts of the research paper investigate the characteristics, signs and stages of detection of the severe mental arousal’s state. The third part examines the objective and subjective features of Articles 120 and 127 of the Criminal Law. The fourth part of the research scrutinizes the foreign regulation of a crime committed in a state of severe mental arousal. A criminal offense that was committed in the heat of passion, has mitigating circumstances which may cause the lenient sentence. In order to qualify an offense in mitigating circumstances, all the criteria of the legally described heat of passion must be met. The aim of the bachelor thesis is to examine the qualification problems of Articles 120 and 127 of the Criminal Law. A severe mental state of arousal is divided into a physiological state of affect and a pathological state. In order to determine the existence of the heat of passion, all conditions must be met and the presence of the heat of passion at the time of the criminal offense must be determined during the forensic medical examination. The state of the severe mental arousal is described in Articles 120 and 127 of the Criminal Law, and as a mandatory condition is that the victim has committed violent acts or serious insults of the honor and dignity of the culprit. The composition of a criminal offense in Article 127 of the Criminal Law and Article 120 is very similar. Meanwhile, if the criminal offense in the heat of passion has been committed under the circumstances that met the requirements of Article 117 of the Criminal Law, then the abovementioned offense must be classified according to Article 127 of the Criminal Law. Finally, after comparing the regulation of Article 120 of the Criminal Law with the Foreign Criminal Code, it was detected that in the foreign regulations, not only violent acts and insults of the victim against the culprit may cause his or her state of severe mental arousal, but the fact that the victim has offended or insulted close person of the culprit. The research paper consists of 52 pages.
