Kopsavilkums
Maģistra darba mērķis ir izpētīt ierobežojumus īstenot pilsoņu tiesības uz valsts dienestu Latvijas Republikā, analizējot Latvijas Republikas tiesisko regulējumu un tiesu praksi, un, vērtējot to samērīgumu, konstatējot problēmas, piedāvāt to iespējamos risinājumus. Latvijas pilsoņiem garantētas tiesības pildīt valsts dienestu, ievērojot vienlīdzības un diskriminācijas aizlieguma principus, var ierobežot likumos, pamatojot ierobežojumu ar objektīviem un saprātīgiem kritērijiem. Vieni no ierobežojumiem pildīt valsts dienestu ir izglītība, iepriekš izdarīts noziedzīgs nodarījums, ierosināts kriminālprocess, darbība Valsts drošības komitejā vai politiskajā organizācijā (partijā), kā arī var tikt noteikts minimālais un maksimālais vecums tiesību izmantošamai. Maģistra darba izstrādes laikā izstrādāti priekšlikumi grozījumiem Korupcijas novēršanas un apkarošanas biroja likumā, Valsts civildienesta likumā, Iekšlietu ministrijas sistēmas iestāžu un Ieslodzījuma vietu pārvaldes amatpersonu ar speciālajām dienesta pakāpēm dienesta gaitas likumā, kā arī ierosināts izstrādāt Ministru kabineta noteikumus.
The aim of the Master's work is to investigate restrictions on the exercise of citizens' rights to the Civil Service in the Republic of Latvia, by analysing the legal framework and case-law of the Republic of Latvia, and by assessing their proportionality, by identifying problems, to offer possible solutions. The rights guaranteed to Latvian citizens to perform public service, while respecting the principles of equality and non-discrimination, may be limited by law, justifying a restriction on objective and reasonable criteria. One of the restrictions on the performance of civil services is education, a criminal offence committed in advance, criminal proceedings have been initiated, activity in the National Security Committee or in a political organisation (party), as well as the minimum and maximum age for the exercise of rights may be determined. Proposals for amendments to the Law of the Corruption Prevention and Combating Bureau, the State Civil Service Law, the Ministry of the Interior System Institutions and Prisons Administration officials with special service grades have been developed during the development of the Master's work, as well as proposed to develop Cabinet regulations.
