Bakalaura darbā “Mājas (istabas) dzīvnieku aizsardzības tiesiskā regulējuma problemātika Latvijā” analizēti galvenie problēmjautājumi Latvijas tiesību sistēmā, kas saistīti ar mājas (istabas) dzīvnieku tiesiskā statusa noteikšanu un dzīvnieku labturības nodrošināšanu. Pētījuma ietvaros vērtēta Dzīvnieku aizsardzības likuma un citu saistīto normatīvo aktu atbilstība mūsdienu tiesību izpratnei, ņemot vērā gan nacionālo likumdošanas kontekstu, gan no starptautiskajām tiesību praksēm izrietošas prasības. Darba mērķis ir identificēt tiesību normas, kuru piemērošana dzīvnieku aizsardzībā ir nepilnīga vai neskaidra, un piedāvāt priekšlikumus to pilnveidei. Pētījumā secināts, ka Latvijas tiesību normās nav nodrošināts terminoloģiski precīzs un saturiski skaidrs mājas (istabas) dzīvnieka jēdziens, kā arī nav paredzēta dzīvnieka tiesiskā statusa nošķiršana no lietas Civillikuma izpratnē. Nav arī definēts dzīvnieku sugu loks, kas uzskatāmas par piemērotām turēšanai mājas apstākļos. Turklāt pētījums apliecina, ka dzīvnieku reģistrācijas sistēma ir ierobežoti piemērojama un praktiski attiecināma tikai uz šauru sugu grupu, tādējādi nerada pietiekamu tiesisku pamatu visaptverošai uzraudzībai. Darbā tiek analizēts arī normatīvais regulējums, kas skar dzīvnieku atsavināšanu un vairošanu, kā rezultātā tika atklātas nepilnības ar mājas (istabas) dzīvnieku reģistrācijas nepilnībām. Tika vērtētas arī likuma normas par klaiņojošo dzīvnieku eitanāziju un to samērīgums. Pētījumā tika salīdzināts Latvijas tiesiskais regulējums ar ārvalstu pieredzi – piemēram, Igaunijas, Lietuvas, Itālijas un Nīderlandes prakse dzīvnieku tiesiskā statusa, definīcijas un turēšanas nosacījumu noteikšanā. Pamatojoties uz pētījuma rezultātiem, autore izstrādājusi priekšlikumus likuma grozījumiem: precizēt dzīvnieka definīciju, noteikt likuma deleģējumu Ministru kabinetam dzīvnieku sugu saraksta izstrādei, kā arī pilnveidot prasības dzīvnieku reģistrēšanai. Piedāvātie risinājumi vērsti uz tiesiskās skaidrības stiprināšanu, dzīvnieku aizsardzības tiesiskā regulējuma un administratīvās prakses uzlabošanu.
The bachelor’s thesis “Regulation of Pet Animal Protection in Latvia” analyses the main problem areas in the Latvian legal system related to the determination of the legal status of pet (indoor) animals and the provision of their welfare. The study evaluates the compliance of the Animal Protection Law and other related regulatory enactments with the contemporary understanding of law, considering both the national legislative context and requirements derived from international legal practices. The aim of the thesis is to identify legal norms whose application in animal protection is incomplete or unclear and to offer proposals for their improvement. The study concludes that the legal norms of Latvia do not ensure a terminologically precise and substantively clear definition of a pet (indoor) animal, nor do they provide for the separation of the animal’s legal status from that of an object in the understanding of the Civil Law. The range of animal species considered suitable for keeping in household conditions is also not defined. Furthermore, the study confirms that the animal registration system is only partially applicable and practically limited to a narrow group of species, thus failing to provide an adequate legal basis for comprehensive supervision. The thesis also addresses the regulation concerning the transfer and breeding of animals, identifying further deficiencies in the pet (indoor) animal registration system. The study evaluates the legal framework for the euthanasia of stray animals, raising questions about the proportionality of existing time limits and their compliance with animal welfare standards. The thesis includes a comparative analysis of Latvian regulations and foreign practices – specifically those of Estonia, Lithuania, Italy, and the Netherlands – regarding the legal status of animals, the definition of pet animals, and the criteria for keeping animals in a household setting. This comparative approach allows for the identification of best practices and highlights Latvia’s regulatory shortcomings. Based on the results of the study, the author has developed proposals for amendments to the law: to clarify the definition of a pet (indoor) animal; to establish a legal delegation to the Cabinet of Ministers for the development of a list of animal species allowed for household keeping; and to improve the requirements for animal registration. The proposed solutions are aimed at strengthening legal clarity, improving the legal regulation of animal protection, and enhancing administrative practice.
