Abstract
Šajā pētnieciskajā darbā autors pēta “fintech” uzņēmumiem izvirzītās NILLTFN prasības Eiropas Savienībā un Latvijā. Autors veic “fintech” uzņēmumu izpēti, noskaidrojot to, kā šādi uzņēmumi atšķiras no tradicionālajām finanšu un kredītiestādēm, kā arī to, kādas ir NILLTFN prasības, kas tiek izvirzītas gan ES līmenī, gan arī dalībvalstu līmenī. Darba gaitā, autors apskata ES normatīvos aktus NILLTFN jomā, kā arī veic Latvijas un Lietuvas tiesiskā regulējuma salīdzinājumu. Papildus, darba gaitā autors min konkrētus “fintech” uzņēmumu piemērus, un apskata, kādā mērā šādiem uzņēmumiem ir jāievēro valstu, kurās tie sniedz pakalpojumus, tiesisko regulējumu. Darba gaitā tiek veikta arī “fintech” uzņēmumu salīdzināšana ar tradicionālajām finanšu un kredītiestādēm, lai noskaidrotu atšķirības starp pakalpojumu sniegšanas veidiem un iekšējo NILLTFN struktūrvienību ieviešanas prasībām.
In this research paper, the author studies the AML/CTF requirements for fintech companies in the European Union and Latvia. The author conducts a study of fintech companies, finding out how such companies differ from traditional financial and credit institutions, as well as what are the AML/CTF requirements that are set both at EU level and at Member State level. In the course of his work, the author examines the EU laws and regulations in the field of AML/CTF, as well as makes a comparison of the legal framework of Latvia and Lithuania. In addition, in the course of his work, the author gives specific examples of fintech companies and examines the extent to which such companies must comply with the legal framework of the countries in which they provide services. In the course of the work, comparison of fintech companies with traditional financial and credit institutions is also carried out in order to find out the differences between the types of service provision and the requirements for the implementation of internal AML/CTF units.
