Uz blokķēdi balstītu viedo līgumu tiesiskais raksturs

Abstract

Pētījuma mērķis ir teorētiski un praktiski izpētīt blokķēdes tehnoloģiju un uz tās balstītā viedā līguma piemērošanas problemātiku. Darbā pētīti “viedā līguma” tehniskie un juridiskie aspekti. “Viedajam līgumam” nav vienotas juridiskas definīcijas. Turklāt Latvijas tiesību zinātnē, problemātika par “viedā līguma” piemērošanas tiesiskajiem aspektiem vispār nav pētīta. Pētījumā analizēts, vai “viedais līgums” rada tiesiskās attiecības, vai tam ir līguma būtiskās sastāvdaļas, vai “viedais līgums” izmantojams kā pierādījums civilprocesā. Pētījuma ietvaros ir izstrādāts “viedā līguma” prototips.The purpose of the Thesis is to research theoretically and practically the problem of application of the block-chain technology and the “smart contract” based on it. The technical and legal aspects of the “smart contract” have been studied within the Thesis. There is no uniform legal definition for the “smart contract”. Moreover, in Latvian law science, the problem of the legal aspects of the application of the “smart contract” has not been studied at all. The Thesis analyses whether the “smart contract” creates legal relationships, whether it has the essential components of the contract, whether the “smart contract” can be used as evidence in civil proceedings. A prototype of “smart contract” has been developed within the framework of the Thesis.
