Taču pilnvērtīgai nozares pārvaldībai ir nepieciešams ieviest sabalansētu atbildības mehānismu starp visiem būvniecības procesā iesaistītajiem, kas sniedz saprotamu veidu trešajām personām gūt zaudējumu atlīdzinājuma kaitējuma rašanās gadījumā. Neraugoties uz dažādiem Ekonomikas ministrijas mēģinājumiem regulēt nozari, skaidri definēta un normatīvajos aktos nostiprināta jomas regulējuma nav, taču precedenti kuros tāds ir nepieciešams - pieaug. Darba mērķis izpētīt atbildības apdrošināšanas institūtu un šobrīd pastāvošo regulējumu Latvijā un citviet Eiropā. Datu un informācijas analīzes rezultātā sniegt vērtējumu par institūta pilnveides perspektīvām Latvijā un nepieciešamajām izmaiņām izstrādes procesā esošajam Būvniecības civiltiesiskās atbildības obligātā apdrošināšanas likumam. Pētījumā tika analizēts pašreizējais Latvijas Republikas tiesiskais ietvars un salīdzināts ar Lietuvas un Igaunijas nacionālo regulējumu, kā arī Eiropas Savienības kopējo nostāju. Tika konstatēs, ka visām Eiropas Savienības dalībvalstīm, ir vienota izpratne par regulējuma nepieciešamību un tajā ietveramajām jomām. Šobrīd spēkā esošais regulējums Latvijas Republikā nesniedz samērīgu tiesību aizsardzību trešajām personām kā arī atbildības sadalījums starp būvniecības procesā iesaistītajiem nav vienlīdzīgs un sabalansēts. Lai īstenotu efektīvu un sabalansētu atbildības sadalījumu katrai procesā iesaistītajai pusei būtu jāatbild atbilstoši iesaistes formai, tādēļ jāveic izmaiņas Civillikumā un Būvniecības likumā. Kā arī jānošķir būvniecības īstenotāji, kas to veic privātām vajadzībām no nekustamo īpašumu attīstītājiem un lielajiem pasūtītājiem. Maģistra darbs sastāv no trim nodaļām. Pirmajā nodaļā tiek analizēts esošais normatīvais regulējums attiecībā uz trešo personu civiltiesisko interešu aizsardzības iespējām būvniecības gaitā. Otrajā nodaļā tiek analizēts citu valstu normatīvais regulējums, kas nosaka kārtību un atbildības augstāk minētajai jomai. Trešajā nodaļā - analizēts Ekonomikas ministrijas izstrādē esošais "Būvniecības civiltiesiskās atbildības obligātā apdrošināšanas likums" un tā potenciālā ietekme uz trešo personu civiltiesisko aizsardzību un pārējām iesaistītajām pusēm. Maģistra darba apjoms ir 74 lpp.The topicality of the theme – various and wide-ranging changes have been made to regulate the construction sector in Republic of Latvia, for example, introduction of the institute of compulsory Civil Insurance. However, full management of the sector requires balanced liability mechanism between all those involved in the construction process, which provides an understandable way for third parties to obtain compensation in the event of damage. Despite various attempts to regulate the sector by the Ministry of Economics, there is no clearly defined parties liability, but precedents in which such regulation is necessary are increasing. The aim of the work is to explore the compulsory civil liability insurance institute and its’ current regulation in Republic of Latvia and elsewhere in the Baltics. As a result of data analysis, an assessment was made regarding the prospects for improvement of the institute. The study analysed the current legal framework of the Republic of Latvia and compared it with other Baltic States and the common position of the European Union. It was found that all Member States of the European Union have a common understanding of the need for regulation and the areas it covers. The current regulation in the Republic of Latvia does not provide proportionate protection of rights to third parties. The division of responsibility among those involved in the construction process is not equal and balanced, which would not be ensured by the draft law proposed by the Ministry of Economics, which would impose all responsibility on the commissioning party. In order to implement an efficient and balanced allocation of responsibilities, each party involved in the building proceedings should respond according to the form of involvement, therefore changes should be made to the Civil Law and the Construction Law. A distinction must also be drawn between construction operators who carry it out for private purposes, property developers and large purchasers. The Master's paper consists of three chapters. The first chapter analyses the existing regulatory framework for the protection of the interests of third parties in the course of construction. The second chapter analyses the regulatory framework of other countries, which sets out the responsibilities for the above-mentioned area. Chapter three - analyses the “Mandatory insurance law on civil liability in construction” developed by the Ministry of Economy and its potential impact on the legal protection of third and other parties involved.
