Abstract

Bakalaura darba „Ārstniecības personas tiesiskā kompetence un atbildība” tēmas aktualitāte pamatojas ar atziņu, ka ārstniecības personu kompetences un atbildības ietvarā ir svarīgi skatīt pacientu tiesību aizsardzību. Ārstniecības personas ir vienīgā profesiju grupa, kurai par profesionālo pienākumu nepienācīgu pildīšanu ir izdalīta kriminālatbildība, tomēr atsevišķi ārsti un juristi pauž idejas, ka kriminālatbildību ārstniecības personai par Krimināllikuma 138. pantā noteikto vajadzētu izslēgt pavisam. Darba mērķis ir izpētīt ārstniecības personas tiesisko kompetenci un atbildību Krimināllikuma 138. panta kontekstā, sasaistot to ar ārstniecības personas rīcību ar pacienta tiesībām uz informēto piekrišanu tiesisko regulējumu, identificēt problēmjautājumus un izstrādāt priekšlikumus esošā tiesiskā regulējuma uzlabošanai. Darbā tika pētīta ārstniecības personas tiesiskā kompetence vērtējot pacienta tiesības uz informēto piekrišanu, analizēts Krimināllikuma 138. panta sastāvs, kas nosaka ārstniecības personu profesionālo pienākumu nepienācīgu pildīšanu, kā arī ārstniecības personas krimināltiesiskās atbildības izslēdzošos apstākļus. Darba galvenā atziņa ir tā, ka ārstniecības personai kriminālatbildība iestāsies tādos gadījumos, ja ārstniecība tiks veikta bez pacienta informētās piekrišanas apstākļos, kad to bija jāiegūst un tās rezultātā pacients gūs vismaz vidēji smagus miesas bojājumus. The topics of the Bachelor's “Legal Competency and Liability of a Medical Person” work are highlighted by the fact that it is important to see the protection of patients' rights within the competence and responsibility of medical practitioners. Medical practitioners are the only group of professions for which criminal responsibility has been allocated for the improper performance of professional duties, but individual doctors and lawyers have ideas that criminal liability of a medical practitioner should be excluded altogether for the purposes of Article 138 of the Criminal Law. The aim of the work is to explore the legal competence and responsibility of a medical practitioner in the context of Article 138 of the Criminal Law by linking it to the behaviour of a medical practitioner with the legal framework of the patient's right to informed consent, identifying issues and developing proposals to improve the existing legal framework. The work examined the legal competence of a medical practitioner in assessing the right of the patient to informed consent, analysing the composition of Section 138 of the Criminal Law, which determines the inadequate performance of the professional duties of medical practitioners, as well as the conditions governing the exclusive criminal liability of the medical practitioner. The main knowledge of the work is that a medical practitioner will be held criminally liable in cases where the medical treatment is performed without the informed consent of the patient in circumstances where it was to be obtained and the patient will result in at least moderate bodily injury.
